<br />Measure No. <br /> <br />Section 20 of the Eugene Charter of 1976 is hereby amended by numbering the current language as <br />Subsection (2) and adding a new Subsection (1), to provide as follows: <br /> <br />Section 20. Election. <br />(1) The City Council shall provide by ordinance that the Mayor and City <br />Councilors shall be elected by preference voting. For the purposes of this subsection, preference <br />voting means a system of voting for candidates for nomination or election authorized by section 16, <br />Article II of the Oregon Constitution, under which an elector may express the elector's first, second <br />or additional choices among the candidates for nomination or election. The City Council shall <br />determine when preference voting should first be used. <br /> <br />(2) Immediately after the votes at any municipal election have been canvassed, <br />the city officer in charge of administering elections shall issue to each person declared by the <br />canvasser to have been elected at the election a certificate of election. The certificate shall be prima <br />facie evidence of the facts therein stated, but the city council shall be the judge of the election and <br />qualifications of the mayor and councilors, and in case of a contest between two or more persons <br />claiming to be mayor or councilor, shall determine the contest. <br /> <br />Exhibit 1 <br />
