<br />RESOLUTION NO. 4683 <br /> <br />A RESOLUTION EXTENDING THE COMPLETION DATE FOR <br />CHILD CARE INCORPORATED TO SATISFY CONDITIONS <br />UNDER RESOLUTION 4442. <br /> <br />The City Council of the City of Eugene finds that: <br /> <br />A. On January 23, 1995, Resolution 4442 was adopted authorizing the transfer of two <br />undeveloped parcels of real property, Tax Lots 700 and 800, Assessor's Map 17-04-25-13 on <br />Thomason Lane abutting Maurie Jacobs Park, to Child Care Incorporated ("CCI"), subject to the <br />following conditions: <br /> <br />(a) That CCI apply for and obtain a Conditional Use Permit for its <br />intended use of the property within four years from the adoption of Resolution 4442; <br />and <br /> <br />(b) That CCI provide confirmation to the City that at least 80% of the <br />funding for the relocation project had been secured prior to commencement of <br />construction of the project and that the funding be confirmed, construction <br />commenced, and the relocation occur within five years from the adoption of <br />Resolution 4442. <br /> <br />B. CCI has obtained a Conditional Use Permit and has provided confirmation to the City <br />that at least 80% of the funding for the relocation project has been secured. <br /> <br />C. A building permit was issued in October, 2000, and it is in the public interest that <br />the expiration date for commencement of construction, and the relocation, as set forth in Resolution <br />4442, should be extended to December 31,2003. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a <br />Municipal Corporation of the State of Oregon, as follows: <br /> <br />Section 1. Based on the above findings, which are hereby adopted, the City Manager is <br />authorized to execute such documents necessary to transfer, for no monetary consideration, Tax Lots <br />700 and 800, Assessor's Map 17-04-25-13 on Thomason Lane, Eugene, Oregon, to CCI to be used <br />to provide child care for families, including low income families. <br /> <br />Section 2. If CCI fails to commence construction and relocate to the Thomason Lane site <br />by December 31, 2003, title to the two parcels shall revert to the City. <br /> <br />Resolution - 1 <br />
