<br />RESOLUTION NO. 4717 <br /> <br />A RESOLUTION ADOPTING THE SYSTEMS <br />DEVELOPMENT CHARGE METHODOLOGIES. <br /> <br />The City Council of the City of Eugene finds as follows: <br /> <br />A. On May 13, 1991, the Systems Development Charges (SDC) Methodology was <br />adopted by Ordinance No. 19773. That Ordinance provided that all future modifications to the <br />Methodology be made by Administrative Order of the City Manager. <br /> <br />B. Subsequent amendments to the SDC Methodology were made by Administrative <br />Orders. The most recent amendment was made by Administrative Order No. 58-01-11-F on June <br />29, 2001. <br /> <br />C. The 2001 Legislative Assembly amended the state SDC statutes and clarified that the <br />process for adopting and amending the SDC Methodologies should be by resolution or ordinance. <br />However, adjustments to SDC rate factors and cost indices may be accomplished administratively <br />by the City Manager as authorized under section 2.020 of the Eugene Code, 1971. <br /> <br />NOW, THEREFORE, based upon the above findings, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a <br />Municipal Corporation of the State of Oregon, as follows: <br /> <br />Section 1. The City Council hereby adopts the Systems Development Charge Methodologies <br />attached hereto as Exhibit A. <br /> <br />Section 2. Adjustments to SDC rate factors and cost indices shall be made administratively <br />by the City Manager as authorized under section 2.020 of the Eugene Code, 1971. Amendments to <br />the SDC rate factors and cost indices made by Administrative Order shall be appended to the SDC <br />Methodologies currently in effect. <br /> <br />Section 3.
