<br />EXHIBll""H" <br /> <br />May 14,1996 <br /> <br />TO: <br /> <br />Hearings Official <br /> <br />Mary Haworth Thompson, 84 Green Lane, Eugene, OR 97404 <br />Timoci and Mary Sailada, 62 Green Lane, Eugene, OR 97404 <br /> <br />SUBJECT: Request that the hearings official recommend in his report to the city council- <br />on the formation of a local improvement district for the 1996 phase of the Santa <br />Clara sewer improvement project - that Basin 96S be modified by eliminating <br />the properties at 84 and 62 Green Lane. <br /> <br />FROM: <br /> <br />Exclusion from local improvement district <br /> <br />Policies governing the creation of a new service district are specific as to the reason <br />properties are included within its boundaries. The properties owned by Mary Thompson, 84 <br />Green Lane, and Timoci and Mary Sailada, 62 Green Lane, do not conform to the <br />requirements expressed in the Metropolitan Area General Plan. <br /> <br />Policy #14 (Page II-B-5) lists 5 criteria that must be satisfied. The first requirement is that <br />there be no other method of delivering the public service. The text is as follows: <br /> <br />Metro Area General Plan <br /> <br />II. Fundamental Principles <br />B. Growth Management and the Urban Service Area <br /> <br />14. Creation of new service districts or zones of benefit within the jurisdictional <br />boundaries of the Metropolitan Plan shall be considered only when all of the <br />following criteria are satisfied: <br /> <br />a. There is no other method of delivering public services which are required to <br />mitigate against extreme health hazard or public safety conditions. <br /> <br />b. The three. . . <br /> <br />(Page II-B-5) <br /> <br />The southern boundary of each of these properties is adjacent to a public sewer and the <br />dwellings on these properties are connected to that sewer. <br /> <br />Backg rou nd <br /> <br />Tax lots 1900 (Thompson-84 Green Lane) and 2000 (Sailada- 62 Green Lane) are <br />connected to a public sewer that extends along the full length of the south property lines. <br />(This sewer was privately constructed then given to the city.) <br /> <br />On February 3, 1982, the Metro Plan was adopted by Lane County.
