<br />ADMINISTRATIVE ORDER NO. 58-06-09 <br />of the <br />City Manager <br /> <br />Delegating the City Managers Authority under Sections 7.635 <br />and 7.640 (Plantings within Rights-of-Way) to the City's Urban <br />Forester. <br /> <br />The City Manager of the City of Eugene finds that: <br /> <br />A. Under the provisions of Chapter IV, Section 16 of the Eugene Charter of 2002 the <br />City Manager is designated as the administrative head of the City, specifically authorized to <br />appoint and remove all employees (except as otherwise provided in the Charter), organize, and, <br />as deemed necessary, disband and reorganize various City departments, and to enforce all <br />ordinances of the City. <br /> <br />B. Section 7.635 of. the Eugene Code, 1971 ("EC") contains provisions governing <br />the planting of trees, shrubs, or other plants within public rights-of-way, with the type, location, <br />spacing and number of each subject to the approval of the City Manager, or the Manager's <br />designee prior to issuance of a permit. EC Section 7.640 further provides that a tree species not <br />listed in the adopted Street Tree Species/Variety List may be planted within a public right of way <br />if it is specifically authorized in writing by the City Manager or the Manager's designee. <br /> <br />C. The City's Urban Forester is the most qualified person to review permit <br />applications and make the determinations required by EC 7.635 and 7.640, and should be <br />delegated that authority. <br /> <br />NOW, THEREFORE, <br /> <br />The City Manager of the City of Eugene Orders and Directs that: <br /> <br />Section 1. The City Manager's duties set forth in Sections 7.635 and 7.640 of the <br />Eugene Code, 1971 are hereby delegated to the City's Urban Forester. <br /> <br />Section 2. Upon finding it wquld be more efficient and in the public interest to do so, the <br />Urban Forester may, by administrative order filed with the City Recorder, sub-delegate any of <br />the duties and responsibilities delegated herein. <br /> <br />, G~ <br />Dated and effective this -+- day O:ijst. 20~6. .......--; ~ <br /> <br />'-~~ \ <br /> <br />r- Dennis M.
