Attachment A: Option A ORDINANCE NO. AN ORDINANCE CONCERNING THE PROHIBITION OF SMOKING WITHIN THE DOWNTOWN CORE AND ALLOWING CERTAIN PROPERTIES OUTSIDE THE DOWNTOWN CORE TO OPT IN; AMENDING SECTION 6.230 OF THE EUGENE CODE, 1971; AND PROVIDING FOR A SUNSET DATE OF NOVEMBER 1, 2017. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. Subsections (2)(q) and (r) of Section 6.230 of the Eugene Code, 1971, are added to provide as follows: 6.230 Smoking Prohibited in Public Places and Places of Employment. (2) Smoking is prohibited in all public places and all places of employment within the city, including, but not limited to the following: (q) Within the downtown core as that area is defined in section 4.871 of this code. Notwithstanding the prohibition contained in this section, the city manager is authorized to permit smoking after 6 p.m. in designated areas adjacent to private establishments that request such permission and that comply with the rules adopted by the city manager under section 2.019 of this code. (r) If requested by the property owner and approved by the city manager, public rights-of-way adjacent to properties where smoking is prohibited by subsections (2)(a) -(p) of this section, and public rights-of-way adjacent to smoke free publicly owned properties. The request shall comply with the rules adopted by the city manager under section 2.019 of this code. Section 2. Section 1 of this ordinance shall sunset and be repealed, effective November 1, 2017, unless extended or made permanent by future Council action. Section 3. The City Recorder, at the request of, or with the consent of the City Attorney, is authorized to administratively correct any reference errors contained herein, or in other provisions of the Eugene Code, 1971, to the provisions added, amended or repealed herein.
