change in use or occupancy, as defined in the Building Code, shall comply with all the <br />requirements of the technical codes or these regulations which may be applicable to new <br />use or occupancy. Any addition, alteration or repair to a building or structure which <br />involves a change in use or occupancy shall not exceed the height, number of stories and <br />area permitted for a new building. <br />8.4 Maintenance. All buildings, structures, electrical, mechanical and <br />plumbing systems, equipment and fixtures, both existing and new, and all parts thereof, <br />shall be maintained in a safe and sanitary condition. All devices or safeguards which are <br />required by the technical codes or these regulations shall be maintained in conformance <br />with the code edition under which installed. The owner or his or her designated agent shall <br />be responsible for the maintenance of buildings, structures, electrical, mechanical and <br />plumbing systems, equipment and fixtures. To determine compliance with this subsection, <br />the Building Official may cause a structure, system, equipment or fixture to be reinspected. <br />9. Moved and Temporary Buildings. Buildings and structures, moved into or within <br />the jurisdiction of the City and electrical, mechanical and plumbing systems, equipment and <br />fixtures which are part of such buildings and structures, shall comply with the provisions of the <br />technical codes and these regulations for new buildings, structure, and electrical, mechanical, and <br />plumbing systems, equipment and fixtures. Nothing in this subsection shall be construed to mean <br />that all heating, plumbing and electrical systems shall be replaced with systems meeting current <br />standards for new construction, except that any life-threatening deficiencies in those systems shall <br />be repaired. <br />10. Temporary Structures. Temporary structures such as reviewing stands and other <br />miscellaneous structures, shed, canopies or fences used for the protection of the public around and <br />in conjunction with construction work may be erected by special permit from the Building Official <br />for a limited period of time. Such buildings or structures need not comply with the type of <br />construction or fire -resistive time periods required by the technical codes or these regulations. <br />Temporary buildings or structures shall be completely removed upon the expiration of the time <br />limit stated in the permit. <br />11. Historic Buildings. Repairs, alterations, and additions necessary for the <br />preservation, restoration, rehabilitation or continued use of a building or structure, or electrical, <br />mechanical or plumbing system, equipment or fixtures located within that building or structure, <br />may be made without conformance to all the requirements of the technical code or these <br />regulations when authorized by the Building Official, provided: <br />11.1 The building or structure has been designated by official action of the legally <br />constituted authority of this jurisdiction as having special historical or architectural <br />significance. <br />11.2 Any unsafe conditions as described in these regulations or the technical codes <br />are corrected. <br />11.3 The restored building or structure will be no more hazardous based on life, <br />Administrative Order - Page 8 of 40 <br />
