<br />ORDINANCE NO. ___________ <br /> <br />AN ORDINANCE AMENDING THE EUGENE-SPRINGFIELD <br />METROPOLITAN AREA GENERAL PLAN (METRO PLAN) TO REVISE <br />THE GOAL 5 SIGNIFICANT MINERAL AND AGGREGATE <br />RESOURCES INVENTORY AND REDESIGNATE FROM <br />“AGRICULTURE” TO “SAND & GRAVEL;” ADOPTING SAVINGS AND <br />SEVERABILITY CLAUSES; AND PROVIDING AN EFFECTIVE DATE. <br /> <br />The City Council of the City of Eugene finds that: <br /> <br /> <br />A. <br /> In August 2005, application No. PA 05-6151 was made to Lane County for a <br />Type II Metro Plan Amendment to add property located outside the Metro Plan UGB and within <br />the Metro Plan Boundary to the Metro Plan Goal 5 Inventory of Significant Mineral & <br />Aggregate Sites, to change the Metro Plan designation for that property from “Agriculture” to <br />“Sand & Gravel” and to concurrently rezone that property in the County’s Rural Comprehensive <br />Plan. <br /> <br />B. <br /> Sections 9.7700 through 9.7750 of the Eugene Code, 1971 (“EC”) set forth <br />procedures for amendment of the Metro Plan. Pursuant to the procedures described at EC <br />9.7730(2)(b), the Board of Commissioners of Lane County referred the above-described <br />application to the City Council of the City of Eugene for City action on the proposed Metro Plan <br />amendments. <br /> <br />C. <br /> The Eugene Planning Commission reviewed the proposal with the Lane County <br />Planning Commission in public hearings on November 15, 2005 and January 25, 2006, <br />deliberated jointly on July 25, and August 30, 2006 and the matter was forwarded to the City <br />Council and Board with formal Planning Commission recommendations. <br /> <br />D. <br /> Evidence exists within the record indicating that the proposal meets the <br />requirements of Chapter 9 of the Eugene Code, 1971, and the requirements of applicable state <br />and local law. <br /> <br />E. <br /> The City Council has conducted a public hearing and is now ready to take action. <br /> <br /> <br />NOW, THEREFORE, <br /> <br /> THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br /> <br />Section 1. <br /> The subject site, consisting of, tax lots 3600, 3601, and 3700 of map 17-04- <br />12-00; tax lot 3600 of map 17-04-12-20; tax lots 5600, 6200, and a portion of 100 of map 17-04- <br />12-31; and tax lots 300, 400 and a portion of 600 of map 17-04-12-40; shall be added to the <br />Metro Plan Inventory of Significant Mineral and Aggregate Sites. based on findings and <br />conclusions as described in Exhibit “B” attached and incorporated herein. <br /> <br />Ordinance - 1 <br /> <br />
