(A) For which the PAPA application does not provide <br />information sufficient to determine clear and objective measures <br />to resolve identified conflicts; <br />(B) Not requested in the PAPA application; or <br />(C) For which a significant change to the type, location, or <br />duration of the activity shown on the PAPA application is <br />proposed by the operator. <br /> <br />We find that the applicant has demonstrated throughout this section that Lane County and <br />the City of Eugene can and should allow mining within the proposed expansion area. Following <br />the decision to allow mining within the proposed expansion area, Lane County and the City of <br />Eugene shall amend the Metro Plan map to designate the subject property as “Sand and Gravel”, <br />shall amend the Metro Plan Goal 5 Significant Aggregate Site Inventory to include the proposed <br />expansion area therein and shall rezone the property to “Sand, Gravel and Rock Products.” <br /> <br />To implement our decision to allow mining within the proposed expansion area, our <br />respective ordinances shall include the following special conditions and procedures regulating <br />that mining: <br /> <br />Noise <br /> <br />? <br /> <br />Limit the first and second lift mining operations to the time period from 7 o’clock AM to <br /> <br />10 o’clock PM. <br />? <br /> <br />Conduct all mining within the proposed expansion area consistent with the alternative <br />mining procedures provided in Tables 7 and 8 of the Daly-Standlee noise study. <br /> <br />Dust <br /> <br />? <br /> <br />Implement the LRAPA-approved Fugitive Dust Control Program on the proposed <br /> <br />expansion area. <br />? <br /> <br />The excavation will be kept in a wet condition by the seepage of groundwater into it. <br />? <br /> <br />The excavation shall occur in phases to minimize the size of the area being disturbed at <br /> <br />any one time. <br />? <br /> <br />The main internal roadway (haul roads) used for onsite truck traffic shall be located as far <br /> <br />as practicable from the boundary of the proposed expansion area. <br />? <br /> <br />A water truck shall be available at all times to water the internal haul roads at a frequency <br /> <br />specified by the Fugitive Dust Control Program. <br />? <br /> <br />The proposed expansion area will be sprinkled with water as necessary to control dust <br /> <br />during mining and/or overburden removal. <br />? <br /> <br />Fifty-foot setbacks shall be maintained around the proposed expansion area boundary <br /> <br />except near residences where the setback shall be 150 feet. <br />? <br /> <br />Reclaimed areas will consist of open water features and vegetated areas to minimize <br /> <br />erosion and dust generation. <br /> <br />Flooding <br /> <br />? <br /> <br />All mining activity shall occur consistent with the proposed mining methodology of this <br />application. <br /> <br />Page 20 – FINDINGS OF FACT <br /> <br />
