Goal 6 requires that air, land and water resources of the state be maintained and improved <br />by assuring that future development, in conjunction with existing development, does not violate <br />applicable state and federal environmental quality standards, and does not exceed the carrying <br />capacity of local airsheds, degrade land resources or threaten the availability of such resources. <br />The State of Oregon, City of Eugene and Lane County have sufficient regulatory measures in <br />place so as to ensure that existing land use activities, as well as any future development on the <br />site, will not produce any unanticipated impacts resulting from the proposed amendments. <br /> <br />The Lane Regional Air Pollution Authority (LRAPA) regulates the Lane County airshed <br />and the industries within it. LRAPA rules and permit requirements regulate the release of <br />particulate matter into the air. Its permit system for emissions provides the regulatory measures <br />that maintain the carrying capacity and quality of the airshed consistent with applicable state and <br />federal environmental quality standards. An Air Contaminant Discharge Permit (ACDP) is <br />required for the aggregate processing equipment and mining activities on the subject property. <br />Delta Sand & Gravel currently operates it existing, adjacent, facility under an ACDP issued by <br />LRAPA (Permit No. 20119) that permits and regulates dust emissions generated by (1) <br />processing equipment; (2) storage piles; (3) roadways; and (4) yard activities. In addition to the <br />specific standards for particulate matter emissions that apply to the process operations, the <br />ACDP includes a requirement to follow the LRAPA-approved Fugitive Dust Control Program <br />for the existing facility. When Delta Sand & Gravel expands its operations onto the proposed <br />expansion site, it will implement the Fugitive Dust Control Program on the expansion area to <br />assure that its operations continue to comply with applicable state and federal air standards. <br /> <br />Wastewater discharge is prohibited under administrative rules and the requirements of the <br />applicant’s DOGAMI permits. The mining operation requires no onsite systems for domestic <br />water or sewage disposal. <br /> <br />A reclamation plan has been prepared and is required to be approved by DOGAMI with <br />respect to restoring land quality. Uses of the reclaimed expansion area will be consistent with all <br />Goal 5 requirements and will depend on land use regulations existing at that time. The <br />protection of the expansion area for natural resource activity and the rehabilitation of it for reuse <br />will maintain the quality of the land. <br /> <br />Therefore, we find that approval of the proposed amendments will not produce results <br />that will be in conflict with or inconsistent with the purpose and intent of Goal 6. <br /> <br /> Goal 7 - Areas subject to Natural Disasters and Hazards. <br />To protect life and property from natural disasters and hazards. <br /> The expansion area is partially located within an un-numbered A zone of the <br />Willamette River flood plain as illustrated on the Flood Area Insurance Map (FIRM) (Panel <br />1126 of 2975, effective June 2, 1999). It is located immediately west of a Flood Insurance <br />Study (FIS) area that has defined floodways and base flood elevations of the Willamette <br />River. <br /> Because the floodway for the Willamette River is determined to be substantially east <br />of the expansion area, the FIS has determined through definition of the floodway that the <br />expansion area could be completely obstructed without increasing the water-surface elevation <br />of the 100-year flood more than one foot at any point. <br /> All mining activity proposed for the expansion area will occur as excavation taking <br />place below existing ground surfaces. Overburden will be removed and stockpiled in areas <br />with elevation higher than base flood elevations or in areas currently below existing ground <br />Page 24 – FINDINGS OF FACT <br /> <br />
