<br />'5~ <br /> <br />,I <br /> <br />An Ordinance adopting the surveYt plat and report of the City Engineer as to <br />the proposed opening of Polk Street from 12th Avenue to the South Ci ty Limi ts, was ~,~;~ <br />read the first time and passed its second and third readings by title by unanimous ~~ <br />consent under suspension of the rule and was placed on,its final passage. The ayes L~ <br />and nays were called, all present voting aye, naYt none. The Ordinance was declared <br />passed and numbered 6786. <br /> <br />The following resolution was offered and unanimously adopted: <br /> <br />RESOLUTION. <br /> <br />Whereast it appears to the Oommon Council of the City of Eugene that hereto- <br />fore Lot No.2, in Block No. Q in Hendrick's Amended Addition to Eugene, Lane <br /> <br />County, Oregon, was sold for delinquent taxes for the year 1919, which suit was <br /> <br />filed January 14, 1924, and pursuant to said suit sheriff's deed to Lane County, <br /> <br />Oregon, was issued dated Aue;ust 9, 1924, and recordecl September 9, 1927, cohveying <br /> <br />to Lane CountYt Oregon, title to said property under such tax foreclosure, and <br /> <br />Whereas, thereafter and on October 17, 1925t Lane County re-conveyed said <br /> <br />property to Oren C Davis and that the said Oren C Davis subsequently conveyed said <br /> <br />property to William A Taylor and Juetta T Taylort husband and wifet <br /> <br />And it Further appearing to the Common Council that said property v~s encum- <br /> <br />I <br /> <br />bened with certain municipal liens, to-Wit; Sewer assessment levied January 26, <br />19t3t on which there is unpaid ~25.4l and interest from January 26, 1913, docketed <br />in B00k 2, at Page 180 of the Lien records of the City of Eugene, and <br /> <br />Whereas, said property is likewise encumbered with a municipal lien in the sum <br /> <br />of ~70.14 for grading and graveling the street opposite said property, with interes <br /> <br />from August 8,1921, which lien is docketed at Page 456 of Volume 3 of the docket <br />of City liens of the City of Eugenet Oregon, and <br /> <br />Whereast application has been made to the City Council by William A Taylor <br /> <br />and Juetta A Taylor for the cancellation of such liens for the reason that upon <br /> <br />the sale of the property to Lane County such liens were in fact cut off and render- <br /> <br />ed void but that said liens constitute a cloud against applicants' propertYt and <br />\ihereas, the City Attorney has been authorized by the Gommon Council to make <br /> <br />a suitable settlement with the owner of said property for the cancellation of said <br /> <br />liens, and the City attorney has agreed with the present owners that upon the pay- <br /> <br />ment of ~25.00 to the City of Eugene that such liens shall be cancelled upon the <br /> <br />lien docket of the City. <br /> <br />. <br />THEREFORE be it resolved by the Common Council of the City of Eugenet Oregon, <br /> <br />that the City Treasurer be and he is hereby directed to cancel upon the lien docket <br /> <br />of the City of ~ugenet that certain sewer assessment in the sum of 025.41 and <br /> <br />I <br /> <br />interest from January 26, 1913, docketed at page 180 of Volume 2, and also that <br /> <br />certain assessment for grading and graveling in the sum of ;;p'70.14 docketed August <br /> <br />S, 1921, at pa@ 456 of Yollime33 of the City lien docket, be and they are hereby <br /> <br />~ <br />
