<br /> figures as follows, to-wi t:

<br /> TO THE MEMBERS OF THE COMMON COm~CI L OF EUGENE, OREGON
<br /> You, and each of you, are hereby notified that there has been,. and is
<br /> called a special meeting of _the Common Council of the City of Eugene, Oregon,
<br /> to convene in the City Hall in Eugene, Oreggn, at the hour of 5:00 o'clock P. M.
<br /> on the 15th day of November, 1928, for the following purpose only, to-wit:
<br /> To reconsider the action of _the Common Council passed at its regular
<br /> meeting on November 13, 1928, in wh ich it was or dered that the sidewalk on
<br /> Olive street between 19th and 20th Avenues be constructed on the property line.

<br /> Such notice was causddtto be served on all members of the Council except
<br /> R,ugh, who was out of the City.
<br /> There were present at said ~eting, the Mayor and all members of the
<br /> Council except Rugh, who was absent. Meeting wa.s called to order by the Mayor
<br /> at 5:00 o'clock P. M. in pursuants of such call. The call of the Mayor was read.
<br /> Dr. Kuykendall, David Graham, Carl Johnson, Mrs. Maxham, and others spbke
<br /> relative to the order of the City Council issued at its last meeting, ordering
<br /> the sidewalk to be constructed next the property line on the West side of Olil1-e
<br /> street between 19th and 20th Avenues, and asked that such order be rescinded for
<br />I the reason that it means the destruction of the valuable trees growing near or
<br /> adjacent to wh.ere such walk will be 'constructed. MUM discussion was had relative
<br /> to the same, and after such discussion the followi.ng Resolution was offered and
<br /> unanimously adopted:

<br /> Whereas, a large number of property owners residing on property abu tting
<br /> on Olive Street between 19th Avenue West and 20th Avenue West in the City of
<br /> Eu<<;ene, have petitioned the Common Council to rescind its action of November 13,
<br /> 1928, with reference to placing the sidewalk directly on the property line, givin<<
<br /> as reasons ,therefor other 'similar digressions where the common good has required
<br /> it, and fUrther stating that to cut out the property in such a manner as to follow
<br /> the property line with the sidewalk will greatly damage the property owned by the
<br /> petitioners by destroying the natural beauty of the street.
<br /> Be it Therefore Resolved by the Common Council of the City of Eugene that
<br /> the act ion 0 f the council directing that the sidewalk on the West side of Olive
<br /> street from 20th Avenue West, north to 19th Avenue West be cut on the property
<br /> line, be rescinded and that permission be granted the property onwers to construct
<br /> said sidewalk abutting the cu.rb from 20th Avenue West to 19th Avenue West, thus
<br />I permitting the construction of retaining walls and the rets&tion of the present
<br /> beautifuili trees ornamenting said block.
<br /> On motion, Council adjourned.
