<br />And Whereas, the viewers duly appointed by said Ordinance No. 6786 made
<br />and filed a report of their findings of benefits and damages to the property
<br />benefitted and the property d~aged by the opening of said street,

<br />And Whereas, due notice of the consideration of said report was given and

<br />thereafter said report was duly adopted by Ordinance No. 6990, passed and approv-

<br />ed July 9th, 1928,
<br />And Whereas, the Viewers found the amount of <mages in the property taken
<br />to be $600.00 and the henefi ts to the adjoining property an equal amount, and
<br />
<br />the ownership of said property benefitted and damaged, being the same, are de-
<br />
<br />clared t,o be offset against each other, and the time for appeal from the finding
<br />
<br />of said viewers has long since expired,
<br />
<br />THEREFORE, be it resolved by the Common Council of the City of Eugene that
<br />the following described property, being the property described in said Engineer's
<br />
<br />report and in said Viewer's report, towit:

<br />Beginning at the intersection of the South line of Twelfth Avenue with
<br />the East line of Polk Street if produced South; running thence South on the
<br />East line of Polk Street if produced South, 1200 feet to the South City Limits,
<br />thence West 66 feet, thence North 1200 feet to the South line of Twelfth Avenue,
<br />thence East 66 feet to the place of beginning, all in Eugene, Lane County,
<br />Oregon.

<br />is necessary to the opening and establishing of said street and said described
<br />
<br />property is hereby taken and appropriated for the purpose of said street and
<br />
<br />said Polk Stre et is hereby opened, laid ou t, and established from 12 th ,Avenue
<br />
<br />to the South City Limits in said City of Eugene, and the City Engineer is direct-
<br />
<br />ed to prepare and deliver to, the Recorder an accurat,e plat of said street and of
<br />
<br />the property so appropriated for public use, and the recorder is directed to
<br />
<br />file for record with the County Clerk of Lane County said plat and a copy of
<br />thi s resolution.

<br />Stre e t from Seventh Avenue to Ele venth Avenue in the Ci ty of Eugene, Oregon,

<br />said street was duly made and filed and duly adopted by the City Council 'by Ord-

<br />inance No. 4627, passed and approved February 2nd, 1925,
<br />And Whereas, the Viewers duly appointed by said Ordinance No. 4627 made
<br />and filed a report of their findings of benefits and damages to the property
<br />benefitted and the property damaged by the opening of said street,
