<br />And WherElas, due notice of the consideration of said report was given and

<br />thereafter said report was duly adopted by Ordinance No. 5231, passed and approve

<br />opening in the name of HarryD. Cherry and R. W. A. Cherry, Estate, amounted to
<br />$1,250.00,- ancL the benefit s t;o the property in said es tate amounted to $720.00,

<br />And WherEtas, the Ci ty of Eugene paid to Gilmore, McCullough, and Devers,
<br />
<br />the successors in the ownership of said property, the excess of damages over
<br />
<br />benefits by General Fund Warrant No. 25208, in the sum of $530.00,
<br />And Whereas, the damages sustained in the taking of property in said street
<br />opening in the name of Thomas J. Casey and Mamie S. Casey amounted to $600.00,
<br />and the benefits to the property of said Thomas J. and Mamie S. Casey as found in
<br />said viewers x'eport amounted to the sum of $180.00,
<br />And Whereas, said City of Eugene paid to said Thomas J. and ~~ie S. Casey
<br />by General Fund Warrant No. 25209 the sum of $420.00, meeting the excess of damages
<br />
<br />over benefi ts,
<br />
<br />And Whereas, said parties accepted said warrants,
<br />
<br />And Whereas, there was no further objections to said report of viewers, and
<br />
<br />the time for appeal from the said viewer's report has long since expired,

<br />Therfore, be it resolved by the Comnon Council of the City of Eugene that the

<br />following described property, being the property described in said Engineer's
<br />
<br />report and in said viewer's report, towit:

<br />Beginning at a point on the South line of Eighth Avenue .West 1485 feet East,
<br />of the West line of the James Huddleston Donation Land Claim No. 37; running
<br />thence South 819 fe~t, more or less, to the South line of the Harry D. Cherry and
<br />R. W. A. Cherry tract of land; thence West 61.8 feet, more or less, to the West
<br />lihe of Polk Street, if extended, which point is the Northeast corner of Lot 1,
<br />Block 2, Chamber's Addition; thence North along the said West line of Polk Street
<br />if extended, 819 feet, more or less, to the South line of Eighth Avenue West; then e
<br />Eas t 61.8 feet, more or 1 ess, to place of beginning, all in Eugene, Lane County,
<br />Oregon.

<br />Polk Street if extended, 226 feet, more or less, to the said North line of Eighth
<br />Avenue West; thence East 66 feet to the place of beginning, all in 1!.ugene, Lane
<br />County, Oregon.

<br />is necessary to the opening and establishing of said street and said described
<br />
<br />property is heJ~eby taken and appropriated. for the purpose of said street, and
<br />
<br />said Polk Street is hereby opened, laid out, and established from Seventh Avenue
<br />
<br />to Eleventh Avenue in said City of Eugene, and the City Engineer is directed to
<br />
<br />prepare and deliver to the recorder an accurate plat of said street and of the
<br />
<br />property so appropriated for public use, and the recorder is directed to file for
<br />
<br />record with the County Clerk of Lane County said plat and a copy of this resolu-
