<br />The minutes of the regular meet ing of the Common Counc i 1 he Id at the hour' of
<br />7:30 otclock P.M., April 11, 1938. Mayor Large called the meeting to order. Council
<br />man present were: Messrs. Lamb, Hendershott, Read, Page, Hanns, Farrington, Bond
<br />1 and Carlson; absent, none.

<br />The minutes of the previous meeting, March 28, 1938, were presented and
<br />2 ordered filed.

<br />Mr. Jack Kesling, who had purchased the site at 15th and High for the purpose
<br />of erecting a gospel hall, respectfully petitioned the council to allow him to pr~-
<br />ceed with his building plans despite the set-back ordinance, recently enacted by the
<br />cQuncil, inasmuch as he had invest!ga~ed in detail his rights to building on the
<br />property prior, to the enactment and being fully illformed by the City Engineer's Of-
<br />fice, he had completed the transaction and blueprints were ~repared for the proposed
<br />building. He said that the building plans had been approved by the Building Inspect r
<br />with the exception of the set-back provision. Mr. Kesling further pointed out that
<br />within the same block a residenee is situated within eight f~et of the sidewalk and
<br />it was their intention to erect their bUilding to conform with that set-back. The
<br />I 3 request was referred to the Board of Appeals for study.

<br />Leroy Peterson, requested waiver of city license for carnival to be sponsor d
<br />by the Veterans of Foreign ~ars of the United States in Eugene on May 16 to May 21,
<br />He pointed out that revenue derived from this enterprise would be used to satisfy
<br />cQrtain obligations of the organization and to carryon their relief and Americaniza
<br />tion program. The methods used by carnivals in averting payments of city licenses
<br />were thoroughly aired by members of the coullcil. Councilmen questioned the wisdom
<br />of continuing the policy of allowing carnivals to come into the city by way of ob-
<br />taining backing of so~e local organization. Upon motion made and seconded, it was
<br />/ 4 agreed that the regular license fee be waived and it was so ordered.

<br />_ Petition presented by Dr. E. T. Helms requesting that 11th ~venue East from
<br />~illamette to r'ranklin Boulevard be made a through street, was referred to the ~tree
<br />and Police Committees.

<br />Clive Stanley of Ralph and ~tanley Stores requested a change in the zoning
<br />ordinance of the city to allow establishment of a new store at the northwest corner
<br />of 13th and Oak Streets. City Engineer Clubb pointed out that a previous request fo
<br />reclassification of this district had been denied by the Board of Appeals, but in-
<br />asmuch as this is a store building and not a drive-in market, he thought the matter
<br />should go before the Board of Appeals for consideration and it was so ordered.

<br />Mayor Lar~e stated that he had received a communication from the ~tate Highwa
<br />Commission wherein they agree to participate on a 50-percent basis on th~ installati n
<br />of traffic control signals on any intersection of the state highway through the city
<br />o( Eugene. John Beakey, state highway ~ngineer, stated that the vommission, in thei
<br />report to the council, had recommended a total of seven installations, but that two
<br />of these fell beyond the highway; therefore in proceeding with the installation, the
<br />bids should be made on that basis and proportionate of costs taken care of after the
<br />iqstallation is completed. The State Highway Commission operates upon a competitive
<br />b~sis and they will prepare the plans and specifications. The City Engineer was in-
<br />st.ructed to confer with Mr. Beakey and report at the next council meeting the plans
<br />o~ installations showing respective benefits and costs. Councilman Bond suggested
<br />that local labor be obtained for the installation of the lights. Mr. Beakey (stated
<br />that the Commission could not make such restrictions; however, he believed that the
<br />installation would be done by a local electrical firm.

<br />. The Finance Committee reported the following bills to the council with a re-
<br />commendation that they be allowed and motion was made, seconded, and carried that
<br />warrants be drawn for the same. The ayes and nays were called, councilmen voting
<br />aye: Lamb, Hendershott, fieid, Hanns, Page, Farrington, Bond and Garlson; nay, none;
