Simon to act as trustee in their behalf" and tomake"s:' <br />I contract of purchase with Ida H. Giesy, a single person and Elizabeth <br /> Clark and Louis G. Clark, her husband for the following described <br /> real estate, to~wit: <br /> The North half of the Northeast quarter of Section 30; <br /> and the Southeast Quarter of Section 19, in Township <br /> 18 South Range 3 West of the Willamette Meridian, being <br /> a tract of land of 240 acres on the summit of Spencer's <br /> Butte, in Lane County, Oregon. <br /> at a purchase price of $6500.00, $1100.,00 of which was paid by sub- <br /> s#ription and $4400:.00 of which was agreed to be paid in five years <br /> from the date of the contract with interest at five per cent per <br /> annum payable semi-annually, with a privilege of paying any amount <br /> at anytime. <br /> AND, WHEREAS, on the 25th day of February,~ 1938, the sa1d <br /> ClarenceV. Simon made a similar contract with Robert D. Morse and <br /> Olive Morse; husband and wlf~, for the following describe~ real es- <br /> tate, to-wit': <br /> The Northeast Quarter of the Northwest Quarter of Section <br /> 30, Township 18 South Range 3 West of the Willamette Mer-ld~- -. <br /> ian, <br /> . <br />I at a purchase price' of $1200.00, of which $200.00 was paid and the <br /> remaining $1000.00 was to be paid on or before five years from the <br /> date of the contract with interest at five per cent per annum pay- <br /> able annually. <br /> That both of the foregoing contracts were made on behalf of the <br /> City of Eugene and it was proposed that the City of Eugene should <br /> seek an authorization of the electors of the city for the purchase <br /> of what is known as Spencer Butte Park, being the property herein- <br /> before described and authorizilmg a levy of a tax of one-half mill <br /> on the dollar valuation upon all taxable property in the city in <br /> order to raise funds for the purchase thereof. <br /> And now, at this time, an election having been held the authoriza- <br /> tion carried by a large majority and the city is tendered by <br /> ~ Cle:rence V. Simon as Trustee, with an assignment of the contraets <br /> heretofore set out and the city having secured authorization of <br /> the electors, <br /> Therefore, be it resolved by the Mayor and the Common Council of <br /> the city of Eugene that the city of Eugene hereby accepts the <br /> assignment, of each of the above contracts and assumes all obli- <br /> gations thereunder and agrees to carry out the contracts as pro- <br /> vided by their terms. <br />I - Resolution authorizing the Mayor and Common Council to accept, the assign <br /> ment of contract between Robert D.
