It was explained that this sum was to be drawn <br />from the 1938 emergency fund but was not to be expended until 1939. Councilman <br />Bond moved that it be approved and this motion was seconded by Mr. Farrington. At <br />this time City Attorney Calkins was asked to determine whether or not this was a <br />proper emergency expenditure and it was his opinion that it was not. The motion <br />15 was withdrawn and the bill denied. <br /> <br />/ <br /> <br />, . <br /> <br />P.J. Hanns, Chairman of the Fire and Water Committee,'wanted to know the <br />position of the City of Eugene in conjunction with responsibility and liability in <br />the event of accidents arising from runs made by the Fire Department on out-of-town <br />calls. The question was referred to the Judiciary Committee and City Attorney for <br />16 study. <br />/ <br /> <br />I <br /> <br />Councilman Farrington, Chairman of the health Committee, requested that th <br />reply from R.C. Bailey regarding the removal of the trees at 2011 Alder Street, be <br />read. It was revealed that Mr. Bailey understood that the trees must come out, <br />since they were causing so much interference with the, sewer system, and he felt that <br />it would not be unreasonable to expect the city to replace them with a few shade <br />trees. Mr. Farrington stated that the trees had caused further trouble and the <br />17 matter was referred to.the Committee with power to act. <br /> <br />J <br /> <br />Councilman Farrington stated that at a meeting held with City Attorney <br />Calkins and Frank Chambers, owner. of Yates Hotel, they had attempted to seCUl"'e an <br />agreement from Mr. Chambers to have the building demolished by October 1, 1939, but <br />that Mr. Chambers had flatly refused. It was the recommendation of the committee <br />that the City attorney be instructed to proceed with demolition proceedings. Mr. <br />Calkins requested that the reading of any ordinance be .held as he wished to investi- <br />18 gate the entire proceedings in this case and it was so ordered. <br />/ <br /> <br />I <br /> <br />Councilman Bond, Chairman of the Police Committee, reported that Mr. N.R. <br />Hennessy, proprietor of Hennessy Supply Company, located at 745 Charnelton Street <br />had requested parking relief in front of his plsce of business.
