Any issue arising within the council need <br /> not be supported by the petitions. Upon motion made and seconded the resolution was <br /> lapproved in order to avoid unnecessary expense of an election unless a truly rep- <br /> I~esentati ve group of citizens desire a vote. O.6J <br /> WHEREAS, the statutes of the'st;ate of Oregon provide for' <br /> initiative measures and referendum upon measures by initiative p <br /> petitions to be signed by petitioners as fixed by statute or <br /> modified by the city charter thus providing a means for determining <br /> . in advance whether it is a general demand for the SUbmission of <br /> t'hemeasure, and <br /> WHEREA.S, the state law also makes provision for the SUb- <br /> mission of charter amendments by theCommon Council with or without <br /> initiative petition~ and <br /> WHEREAS, the Council believes it to be the true intent <br /> and purpose of the initiative statutes that measures pre posed oy I <br /> individuals or groups of citizens are to be 'tested in advance by <br /> an initiative petition before submission to the electorate and <br /> that the prOVision authorizing the Council to submit proposals <br /> on its own initiative contemplates only such measures as arise <br /> 1n the Council itself and are deemed necessary for the orderly <br /> conduct of the cityts business and that it is not the purpose and <br /> intention of the statute that the initiative petition shall be <br /> made inoperative by the Council's SUbstituting themselves for <br /> the proponent's measure. I <br /> THEREFORE. BE IT RESOLVED BY THE COMMON COUNCIL OF THE <br /> CITY OF EUGENE, that they will nereafter adher.e to what they deem <br /> the spirit and intent of the initiative law and will refuse to <br /> substitute themselves for proponents of measures sought to be <br /> submitted to the electorate under the initiative statute. <br /> ~ I <br />
