<br />l of the Oxborough farm instead of just stopping at the Administration Buildihg.
<br />t'~ II Mr. Oxboro had entered tnto a, contract of sale of the farm to C. W. and Louis
<br />~. Kokkeler and a Contract and agreement with the Kokkelers regarding the cross-
<br />i+;.. ings from the road to the property. The erection of 3 culverts and a drainage
<br />ditch and the moving of the fence was read at this time and a motion was mede,
<br />seconded and carried that the Mayor and Recorder be authorized to sign the
<br />agreement as read. -

<br />The following Resolution for the opening of Fillmore Street from the
<br />alley between 6th &0 7th to the north side of 7th was read at this time and
<br />on motion. , made, seconded and carried was adopted;

<br />
<br />In the matter of the Opening of Filmore Street from the alley south
<br />of 6th avenue West to 7th Avenue West, ih Eugene, Lane County, Oregon.

<br />WHElE'~S, The Common Council of the City of. Eugene by ,Resolution duly
<br />adopted October 25th, 1943 determined to open, layout and establish Filmore
<br />Street from the south line of west 6th St~eet Addition and the South line of
<br />Grand Prairie Addition tothe North line of 7th Avenue,
<br />
<br />And,. WHEREAS, the report and plat of the City Engineer for the opening
<br />of said street was duly made and filed and thereafter duly adopted by the Oity
<br />'Council by Ordinance No. 8779, passed by the Gommon Council, December, 13, 1943
<br />and approved by the May December 15, 194,3, ,
<br />
<br />And, Whereas, the Viewers duly appointed by said Ordinance No. 8779,
<br />made and filed a report of their findings of benefits and damages to the
<br />property benefited and the property damaged by the opening of said ,street,

<br />And, Whereas, the due notice of the consideration of said report was
<br />duly 'adopted by Or<linance No. 8787, which was passed by the Common Council
<br />on March 27th, 1944 and Approved by the Mayor on March 28"lS44,

<br />, And, Whereas, the damages sutained in the taking of property in said
<br />street opening belonging to Patrick C. Uollin~J was fixed at $875.00 and the
<br />benefits to the property of said Patrick C. Collinsrw~s fixed at $117.25,
<br />
<br />And Wheras, the damages sustained by the property of John R. Davis
<br />was fixed at $125.00 and the benefits to John ,R. Davis were assessed at $20.00
<br />that being all the property taken.

<br />And the benefits to the following properties being as follows:

<br />And, Whereas, the City of Eugene has paid to Patrick O. Collins,
<br />damages in the net sum of $757.75, and has paid damages to John R. .Davis in.
<br />the net sum of $105.00 being the amount of damages over the benefits, the City
<br />having issued General Eand Warrant No.6l481 to Patrick C. Collins and General
<br />Fund Warrant No.61482 to John R. Datis1 and the benefits to the remaining
<br />owners are ordered assessed to,the property as described in the report of the
<br />Viewers and the ordinance adopting the report of the Viewers, and whereas,
<br />Patrick C. Collins and John R. Davis have accepted their said warrants.
<br />
<br />And, Whereas, no objections to said report of Viewers have been filed
<br />and the time for appeal has expired.
<br />
<br />Therefore, be it Resolyed by the Common Council of the City of Eugene
<br />that the following described property, b.eing ~heproperty described in said
<br />Engineer'S report and in said Viewer's report, and in the ordinance adopting
<br />the Viewer's report tp-wit:
