Policy10.Annexationtoacitythroughnormalprocessesshallcontinuetobethe <br />highestpriority.(pageIIC5). <br />Policy15.Ultimately,landwithintheUGBshallbeannexedtoacityandprovidedwith <br />therequiredminimumlevelofurbanfacilitiesandservices.Whilethetimeframefor <br />annexationmayvary,annexationshouldoccuraslandtransitionsfromurbanizableto <br />urban.(pageIIC5) <br />TheMetroPlandesignatestheannexationareaasappropriateforresidentialuse.The <br />RiverRoadSantaClaraUrbanFacilitiesPlan(RR/SCUFP)istheadoptedrefinementplan <br />forthesubjectpropertiesandalsodesignatestheareaforresidentialuses.Theproperty <br />iscurrentlyzonedLowDensityResidentialwithUrbanizableLandOverlay(R1/UL).The <br />/ULoverlaywillbeautomaticallyremovedfromthezoningfollowingannexation <br />approval. <br />WithregardtoapplicablepoliciesoftheRR/SCUFP,thesubjectpropertyisnotlocated <br />withinanyofthedescribedsubareas.Further,noneofthegeneralͻwĻƭźķĻƓƷźğƌLandUse <br />tƚƌźĭźĻƭͼatSection2.2appeartobedirectlyapplicabletothesubjectrequest.The <br />ͻtǒĬƌźĭFacilitiesandServices9ƌĻƒĻƓƷͼpoliciesoftheRR/SCUFParedirectedatlocal <br />government;however,thepremiseofthesepolicies(regardingtheprovisionofurban <br />services)istheassumptionthatthepropertieswithintheUGBwillbeannexed. <br />Aspreviouslydiscussedinthissubsection,andfurtherdetailedundersubsection(3) <br />below,theproposedannexationisconsistentwithMetroPlangrowthmanagement <br />policiesandcanbeservedbytheminimumlevelofkeyurbanservices.Theannexation <br />proceduresbeginningatEC9.7800areconsistentwithStatelawandtherefore,asfound <br />throughoutthisreport,theannexationisconsistentwithStatelaw. <br />Therefore,basedonthefindingsabove,theproposalisconsistentwiththeapplicable <br />policiesoftheMetroPlanandapplicablerefinementplan. <br />EC9.7825(3)Theproposedannexationwillresultinaboundaryinwhichtheminimumlevelofkey <br />urbanfacilitiesandservices,asdefinedintheMetroPlan,canbeprovidedinan <br />orderly,efficient,andtimelymanner. <br />CompliesFindings:Consistentwiththiscriterion,theproposedannexationwillresultina <br />boundaryinwhichtheminimumlevelofkeyurbanfacilitiesandservicescanbe <br />NO <br />providedinanorderly,efficient,andtimelymannerasdetailedbelow: <br />YES <br />Wastewater <br />Thereisan8inchpublicwastewatersystemwithineachoftheadjacentstreets,Boyce <br />StreetandBerwinLane,southandeastofthesubjectproperty,respectively.Anonhold <br />wastewaterequivalentassessmentwillbecomedueuponpropertydevelopment. <br />Stormwater <br />Publicstormwatersystemsarenotavailabletoservethisproperty.Alldevelopment <br />proposalsmustdemonstrateconsistencywithfloodcontrolstandards;onsiteretention <br />Lohman, Scott (A 17-4) April 2017 Page 2 <br /> <br />
