<br /> owing the Same to run dry during period regular janitor was absent from the
<br /> building.
<br /> This claim W&s verified by Harry H. Powell, Oregon state Guard, who was
<br /> custodian of the ~ugeneArmory and by ReYlllond F. Olson, Brigadier Genera. Acting e
<br /> the Adjutant General. lJ.'his Claim was has been returned by the V;ar DepaJrment for
<br /> the reason th.at the same was leased to the Governmen~ during the period of the
<br /> alleged d3mage and tha t therefore th e City of Eugen_e is the pa rty to file - the
<br /> claim, not*ithstanding-the State of, Oregon is t he fee owner of the property.
<br /> There .l'1L s now been prepared a CIa im for da.\lla ges on the part of the City
<br /> of Eugene in quadruplicate, therefore,
<br /> BE IT RESOLVED BY THE C01TIiON COUNCIL of the ~ity of Eugene, that the City
<br /> Manager be and he is hereby instructed to Execute on behalf of the,City of Eugene,
<br /> Oregon, a claim for damages against the War Department and to subscribe and swear
<br /> tot he same and forward it to the War Department, Office Pivision Engineer at
<br /> Portland, Oreg on. It
<br /> It was moved by Hawn, seonded by Baile~ that the resolution be adopted.

<br /> I "VVlIEP..EA-S the City of Eugene has reserved from sales of property and now
<br /> owns a strip of land nine feet in width extendir€ from the East line of Teshner's
<br /> Addition to the West line of ,Patterson Street _on each side of 19th Aven~e West.
<br /> VlliEREAS the Cou2.1cil deems it reasonable and convenient that the nine foot
<br /> strip on ea ch side of 19th as aforesaid be designa ted for street pUTp,..ses. I
<br /> , BE IT RESOLVED by the Common Council of the City of Eugene that the
<br /> Mayor and Recorder be and they are hereby ordered to make, execute, deliver, and
<br /> record a deed to the Public for the two nine foot strips above described~"

<br />45 In the ma tter of enforcement of proposed ~ater Board' Regulations on use
<br /> of water, it was moved by Hawn, secondedb y Bailey that the City Manager inform
<br /> the secretary of the '~.ater Board that it is the sense of the Common Council that
<br /> any or all regulations placed on the city water consumer within the city limits
<br /> be extended to consumers outside of the city limits. Motion carried.
<br />46 In the ma tter of a new lease wi th School JJistrict #4, RE: Use of build-
<br /> ings at the Old Avia tion E'ield, it was moved by Bailey seconded by Hawn that the
<br /> proposed lease as submitted by the City Manager be ~pproved and that the proper .'
<br /> ~ city officers be authorized to execute the lease. .Motion carried.
