BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF EUGE1~ I <br />,t......'" <br />..~J1 That the Mayor ,and City Manager be and they are hereby authorized and <br />';.;.:"1 directed to enter into an agreement with the Eugene Medical Center, a corporation <br />ex for the sale by the City and the purchase by the Eugene Medical Center, of the ' <br /> I following described real estate, to-wit: <br /> Commencing at the intersection of 'the South line of Thirteenth <br /> 1 <br /> I Avenue West and East line of Chambers Street, running thence <br /> 'I East along the South line of Thirteenth Avenue West ?58 feet <br /> I . to a point 30?8 feet West of the East line of Taylor Street <br /> I <br /> I if extended South; thence South 334 feet, thence East 150 feet, <br /> I <br /> I thence South 800 feet, thence West 540 feet to the proposed <br /> state highway as located, thence North 340 2 1/2' West, 65? <br /> feet to the East line of Chambers Street, thence North along <br /> the East line of Chambers Street 592 feet to the place of be- <br /> _ ginning, containing 20.19 acres in Eugene, Lane County, Oregon. <br /> at and for a purchase price of $ , to be paid $ upon the exe- <br /> cution and delivery of the contract and the balance of the purchase price paid on <br /> or before <br /> All deferred payments to draw interest at the rate of six per cent per annum, <br /> I payable annually. <br /> I <br /> I The contract shall contain the following provision: <br /> j - <br /> I <br /> I "It is a condi tion of this sale and conveyance that the property shall <br /> I be developed as a Medical Center and for associated service, and cannot be sold <br /> I or leased without the consent of the Common Council of the City of Eugene. Pro- <br /> , <br /> i vided, however, that the Medical Center may mortgage the property to raise money <br /> for the development of the Eugene Medical Center, and such mortgage shall be free <br /> from the above restrictions." <br /> Provided further that should the vendees be unable to finance the I <br /> deve lopment of the proposed Medical Center that, they may sell the property with <br /> no restrictions, other than those reserved for public utilities, buty they must <br /> . first offer it to the City of Eugene at a purchase price of $25,000.00 or the <br /> ! <br /> i price at which they are willing to sell to another, whichever shall be the lesser <br /> I pr ic e. <br /> i <br /> That the contract shall reserve to the City the right to enter upon <br /> , the property and maintain a thirty inch storm sewer now located on the property, <br /> , and further reserving an easement to be used whenever 15th Avenue is extended, <br /> for a new sewer serving this and other property. <br /> In addition to the foregoing, the contract shall provide that the vendees <br /> shall comply and conform to all regulations of the Civil Aeronautics Authority, <br /> I it being understood that the tract of land herein contracted is a part of what is <br /> ! known as the Old Airport. <br /> I <br /> I A copy of the proposed contract is hereto attached and made a part of <br /> ! this resolution." <br /> I It was moved by Hawn, seconded by Davis that the resolution be adopted.
