MEMBERS PRESENT <br />WERE: MR. LUVAAS, CHAIRMAN; MR. GILLILAN; MR. STIEN; AND MR. WILMSEN. <br /> <br />I. REQUEST FROM MR. ROY E. MnRSE AND MR. RAY M. MORSE, DOING BUSINESS AS THE <br />BROADWAY AT 39 EAST BROADWAY--REQUEST WAIVER OF THE SETBACK AND LOADING PROVISIONS AS <br />REQUIRED BY THE ZONING ORDINANCE AS APPLIED TO THE READ YARDS IN, C-3 ZONE. BY <br />UNANIMOUS VOTE THE BOARD GRANTED THE REQUEST DUE PRIMARILY TO THE HARDSHIP IMPOSED <br />ON THE PROPERTY. THE BOARD TOOK COGNIZANCE OF THE FACT THAT ALL EXISTiNG BUILDINGS <br />IN THE BLOCK HAVE BEEN ESTABLISHED TO THE ALLEY LINES, AND FURTHER, BUILDINGS FRONTING <br />ON THE STREETS AT THE EASTERLY AND WESTERLY TERMINI OF THE ALLEY WOULD HAVE SIDE <br />PROPERTY LINES ABUTTING THE ALLEY AND THEREFORE WOULD NOT HAVE TO MEET THE THREE-fOOT <br />SETBACK FROM THE ALLEY. <br /> <br />I <br /> <br />2. . REQUEST FROM EARL J. VAUGHN REQUESTING A REDUCTION IN THE REQUIRED FRONTAGE <br />SETBACK FOR A DUPLEX AT THE NORTHEAST CORNER OF ELEVENTH AVENUE AND TYLER STREET. BY <br />UNANIMOUS CONSENT THE BOARD AGREED TO GRANT THE EIGHTEEN-AND-ONE-HALF-FOOT (18.5) <br />SETBACK AS REQUESTED. <br /> <br />3. REQUEST FROM MR. LAWRENCE JENSEN FOR WAIVER OF SETBACK ON HIS PROPERTY <br />LOCATED AT THE SOUTHERLY TERMINUS OF PROSPECT DRIVE, VICTORIA HEIGHTS ADDITION. <br /> <br />MR. JENSEN REQUESTED A SIX-FOOT SETBACK FOR THE NORTHWEST CORNER OF HIS <br />BUILDING, SAID PORTION Of THE STRUCTURE BEING A GARAGE. THE SOUTHWEST CORNER OF <br />THE BUILDING WOULD BE SET BACK TWENTY-SIX fEET. THIS PROPERTY HAS CONSIDERABLE SLOPE <br />TO THE EAST AND MR. JENSEN CONTENDS THAT IN ORDER TO HAVE A STRUCTURE ON THIS LOT HE <br />WILL HAVE TO BUILD CLOSER TO THE STREET THAN THE ORDINANCE PERMITS. THE BOARD DENIED <br />THE REQUEST AND INSTRUCTED THE BUILDING INSPECTOR TO EXAMINE THE PREMISES TO DETERMINE <br />WHETHER THE STRUCTURE COULD BE SET FURTHER BACK. <br /> <br />4. REQUEST fROM MR. BIGGS FOR THE WAIVER Of fRONTAGE SETBACK ON HIS PROPERTY <br />AT 640 EAST 19TH AVENUE FROM 30 FEET TO 16 FEET. SINCE THE AVERAGE SETBACK FOR FIFTY <br />PERCENT OF THE FRONTAGE IS 30 FEET, THE BOARD RECOMMENUS THAT MR. BIGGS SECuRE FROM <br />THE ADJACENT PROPERTY-OWNER A LETTER STATING SAID PROPERTY-OWNER HAS NO OBJECTION TO <br />THE LESSER SETBACK. MR. BIGGS PLANS A SEVEN-UNIT COURT ON HIS PROPERTY. REQUEST <br />DENIED. <br /> <br />5. REQUEST FROM MR. H. R. KETELL OF THE KETELL CONSTRUCTION COMPANY FOR <br />APPROVAL Of THE WIDTH OF THE SECONDARY STAIRWAY IN THE EUGENE MANOR APARTMENTS, <br />ELEVENTH AVENUE AND FERRY STREET. THE STAIR AS PLANNED HAS A NET WIDTH OF 5'0" <br />OR 60"; WHEREAS THE BUILDING CODE REQUIRES A NET OF 88". SINCE THERE IS AN ADEQUATE <br />SMOKE-PROOF TOWER WITH A MAIN STAIRWAY OF 8'5" IN WIDTH, THE BOARD APPROVED THE REQUEST <br />WITH THE STIPULATION THAT THE FIRE MARSHALL ALSO APPROVE THE NON-CONFORMING WIDTH FOR <br />THE SECONDARY STAIR. <br /> <br />1 <br /> <br />6. A REQUEST FROM MR. W. DION TO ENLARGE HIS GROCERY BY ADDING A WAREHOUSE <br />AND THREE APARTMENTS ABOVE THE ENTIRE STRUCTURE. THIS PROPERTY JS LOCATED AT 1201 <br />WEST ELEVENTH AVENUE (AT TYLER STREET) AND IS A NON-CONFORMING OCCUPANCY. THE AREA <br />IS IN THE R-2 ZONE, DUPLEX RESIDENTIAL, AND THE ORDINANCE DENIES THE ENLARGJNG OF A <br />NON-CONFORMING OCCUPANCY.
