MOTION CARRIED. <br /> <br />27 <br /> <br />A PETITION OPPOSING CAHD ROOM AT 640 WILLAMETTE STREET WAS SUBMITTED AND READ. <br /> <br />IT WAS MOVED BY BOOTH, SECONDED BY ALLEN THAT THE PETITION BE RECEIVED AND PLACED ON FILE. <br />MOTION CARRIED. <br /> <br />28 <br /> <br />COMMUNICATION FROM THE CITY-COUNTY HEALTH DEPARTMENT - RE: CONDEMNATION OF BUILDING AT <br />54 W. 6TH AVENUE WAS SUBMITTED AND READ AS FOLLOWS: <br /> <br />I <br /> <br />>>AN INVESTIAGTION OF THE PREMISES LOCATED UPSTAIRS AT 54 WEST 6TH AVENUE, EUGENE, <br />WHEREIN ONE NELLIE BOOM, AN AGED FEMALE, APPROXIMATELY 73 YEARS OF AGE WAS LIVING, WAS <br />MADE ON JANUARY 31ST, 1950. <br /> <br />THE PREMISE WAS FOUND TO BE IN A COMPLETE STATE OF DISORDER, WATER WAS NOT AVAILABLE, <br />ADEQUATE DISPOSAL FACILITIES WERE NOT PRESENT, HEATING WAS NOT POSSIBLE WITHOUT CONSIOERABLE <br />RISK OF CAUSING FIRE, (NO HEAT WAS PRESENT AT TIME Of INVESTIGATION), AND THE GENERAL <br />CONDITION Of THE PREMISE WAS IN A CONDITION Of BAD REPAIR. <br /> <br />IN VIEW Of THE ABOVE FINDINGS, THE PREMISE IS HEREBY CONSIDERED UNfiT FOR HUMAN <br />HABITATION, AND INIMICAL TO THE BEST INTERESTS OF THE CITY OF EUGENE. <br /> <br />HAVE, THEREFORE, ORDERED THE PREMISE TO BE PADLOCKED AND RECOMMEND CONDEMNATION <br />OF THE ENTIRE BUILDING AND REMOVAL OF THE STRUCTUR~ AS A HEALTH HAZARO AND FIRE HAZARD." <br /> <br />IT WAS MOVED BY HAWN, SECONDED BY CRUMBAKER THAT THE CITY ATTORNEY START PROCEEDINGS AS <br />SOON AS POSSI BLE TO START CONDEMNATION. MOTION CARRIED. <br /> <br />29 <br /> <br />COMMUNICATION FROM THE OREGON STATE HIGHWAY COMMISSION - RE: CURB CUTS ON PROPERTY OWNED <br />BY J. H. BALZHISER WAS SUBMITTED AND READ AS FOLLOWS: <br /> <br />1 <br /> <br />"FOR THE PAST SEVERAL MONTHS WE HAVE BEEN STUDYING REQUESTS FOR THREE CURB CUTS ON <br />PROPERTY OWNED BY J. H. BALZHISER, WHICH PROPERTY CONSISTS OF A 300-FOOT FRONTAGE ON THE <br />NORTHERLY SIDE Of FRANKLIN BOULEVARD (PACIFIC HIGHWAY) IMMEDIATELY EAST OF WALNUT STREET. <br />ORIGINALLY MR. BALZHISER REQUESTED THREE CURB CUTS, AND THESE WERE RESISTED BY THE HIGHWAY <br />COMMISSION BY REASON OF THE FACT THAT SO MANY CURB CUTS NEAR THE JUNCTION OF THE EXISTING <br />HIGHWAY WITH THE PROPOSED JUDKINS POINT-GOSHEN SECTION WOULD CREATE A HAZARD TO TRAFfiC. <br />THE STATE HIGHWAY COMMISSION DEFERRED ANY DECISION ON THIS MATTER UNTIL FURTHER 'INVESTIGA- <br />TION HAD BEEN MADE AND THEY WERE ADVISED AS TO THE PRACTICES ~F THE CITY OF EUGENE IN SUCH <br />MATTERS AND ALSO WHAT PLANS THE CITY OF EUGENE MIGHT HAVE FOR THE ACQUISITION OF THIS <br />PROPERTY FOR PARK PURPOSES. <br /> <br />MR. BALZHISER HAS NOW REDUCED HIS REQUEST FOR CURS CUTS TO ONE. AND THIS IS AT A <br />POINT WHERE NO PARTICULAR HAZARD WOULD BE CREATED. As THE STATE HAS NOT ACQUIRED ACCESS <br />RIGHTS TO THIS PROPERTY, WE ARE NOT IN TOO STRONG A POSITION TO RESIST ONE CURB CUT. <br /> <br />IN ORDER THAT THE HIGHWAY COMMISSION MAY FURTHER CONSIDER THIS MATTER AT ITS NEXT <br />MEETING, WHICH IS ON FEBRUARY 6-7, WE WOULD APPRECIATE ADVICE FROM THE CITY OF EUGENE <br />AS TO ITS PRACTICE IN GRANTING CURB CUTS AND WHAT ITS PLANS ARE, If ANY, fOR ACQUISITION <br />OF THIS PROPERTY. <br /> <br />AN IMMEDIATE RESPONSE WOULD BE APPRECIATED." <br /> <br />THE CITY MANAGER WAS INSTRUCTED TO CHECK WITH THE STATE HIGHWAY DEPARTMENT AND REPORT ON <br />ACTION TAKEN ON FEBRUARY 6TH AND 7TH MEETING OF HIGHWAY COMMISSION. <br /> <br />30 <br /> <br />COMMUNICATION - RE: FIRE PROTECTION ON UNIVERSITY OF OREGON CAMPUS WAS SUBMITTED AND READ <br />AS fOLLOWS: <br /> <br />I <br /> <br />"I SHOULD LIKE TO TAKE THIS MEANS OF EXPRESSING BOTH PERSONALLY AND FOR THE UNIVERSITY <br />MY DEEP APPRECIATION fOR THE COOPERATION OF CITY MANAGER UREN KING, FIRE CHIEF SURFUS AND <br />OTHER CITY OFFICIALS IN CONNECTION WITH THE ACUTE PROBLEM WE FACE ON THIS CAMPUS IN <br />ADEQUATELY CARING FOR THE FIRE PROTECTION OF OUR BUILDINGS. As A RESULT Of THE COOPERATIVE <br />EFFORTS OF THE ABOVE GROUP AND THE WATER BOARD. WE HAVE MOVED DEFINITELY TO A SATISFACTORY <br />SOLUTION Of OUR PROBLEMS.
