<br />RELATIVE TO AN ADDITIONAL SEVEN FEET FOR THE CONSTRUCTION OF THE LANE TOWER APARTMENTS
<br />AT 16TH AND OLIVE STREETS, AND ALSO READ THE REPORT OF THE PUBLIC WORKS COMMITTEE AS

<br />A.M. W'ITH THE FOLLOWING PRESENT: COUNCILMEN CRUMBAKER, CHAIRMAN; KOPPE AND GODLOVE;
<br />CITY MANAGER; CITY ENGINEER AND SENIOR BUILDING INSPECTOR.

<br />THE COMMITTEE MET AT THE CORNER OF 16TH AVENUE AND OLIVE STREET TO REVIEW THE
<br />REQUEST OF THE COATES CONSTRUCTION COMPANY, BUILDERS OF THE LANE TOWER APARTMENTS.
<br />THIS REQUEST WAS THAT THE CITY DEED SEV€*.FEET OF THE PRESENT CITY-OWNED FOURTEEN
<br />FOOT ALLEY RUNNING NORTH AND SOUTH BETWEEN THIS PROPERTY AND THAT OF. THE VETERANS
<br />PROPERTY. THIS REQUEST WAS MADE BY REPRESENTATIVES OF THE COATES CONSTRUCTION COMPANY
<br />ON THE AFTERNOON OF JANUARY 8TH, AFTER THEY HAD DISCOVERED THAT THEIR BUILDING HAD
<br />BEEN LOCATED SEVEN FEET BEYOND THEIR PROPERTY EXTENDING MIDWAY INTO THE FOURTEEN FOOT
<br />ALLEY OWNED BY THE CITY OF EUGENE. THIS REQUEST WAS BROUGHT UP AT THE CITY COUNCIL
<br />MEETING JANUARY 8TH AT WHICH TIME MESSRS. CLARENCE UREY AND JAMES RODMAN, JR. ADVISED
<br />THAT F.H.A. COMMITMENTS NECESSITATED AN ANSWER BY THE CITY OF EUGENE NOT LATER THAN
<br />TUESDAY, JANUARY 9TH, WHICH LEFT VERY LITTLE TIME FOR PROPER CONSIDERATION.
<br />
<br />THE PUBLIC WORKS COMMITTEE AGAIN REVIEWED THIS REQUEST AT THE MEETING TUESDAY
<br />MORNING AND CAME TO THE FOLLOWING CONCLUSIONS.
<br />
<br />I~ THAT THEY WERE NOT IN FAVOR OF CLOSING THE ALLEY WHICH WOULD .BE NECESSITATED
<br />IF THE SEVEN FEET WERE DEEDED TO THE COATES CONSTRUCTION COMPANY. THIS FOURTEEN
<br />FOOT ALLEY WAY HAD BEEN RETAINED BY THE CITY OF EUGENE, AND IT WAS FELT THAT THE
<br />AMOUNT OF TRAFFIC INVOLVED FROM THE VETERAN'S ACTIVITIES AT THE VETERAN'S
<br />MEMORIAL BUILDING, AND WITH THE PROPOSED CONSTRUCTION OF A 122 UNIT APARTMENT
<br />HOUSE IMMEDIATELY ADJACENT ON THE WEST THAT THIS ALLEY WAY SHOULD BE MAINTAINED
<br />FOR EGRESS AND INGRESS AS WELL AS UTILITY AND SAFETY PURPOSES.
<br />
<br />2. IN THE ORIGINAL AUTHORIZATION OF THIS PROJECT IT WAS STIPULATED THAT PARKING
<br />FACILITIES SHOULD BE PROVIDED FOR AT LEAST 50% OF THE APARTMENTS ,AND IT IS FELT
<br />T~AT THEIR PRESENT PLANS FOR 32 GARAGE PARKING SPACES AND 18 OPEN PARKING SPACES
<br />TOTALING ACCOMMODATIONS FOR 50 VEHICLES IS A MINIMUM TO BE APPROVED FOR THIS 122
<br />UNIT PARKING LOT AND THAT THE PARKING SPACES SHOULD NOT BE REDUCED DUE TO THE
<br />ABOVE MENTIONED SEVEN FOOT ERROR.

<br />3; IN REVIEWING THE SETBACK LINES AS STIPULATED UNDER THE BUILDING ORDINANCES
<br />OF THE CITY OF EUGENE WHEREIN THIS PROPOSED BUILDING IS SET BACK TEN FEET ON
<br />OLIVE STREET AND TWELVE FEET ON 16TH AVENUE, THE POSSIBILITY OF WAIVING THE SET-
<br />BACK LINES WAS TAKEN INTO CONSIDERATION AS A POSSIBLE SOLUTION, BUT THE COMMITTEE
<br />DID NOT FEEL THAT A WAIVER OF THE SETBACKS WAS JUSTIFIED, AS ALL OF THE OTHER
<br />PROPERTY IN THIS AREA WAS PROPERLY SET BACK AND ALSO THE SIGHT DISTANCE FOR SAFE
<br />DRIVING WOULD BE IMPAIRED.
<br />
<br />4. IT WAS RECOMMENDED, HOWEVER, THAT IT MIGHT BE FEASIBLE FOR THE COATES
<br />CONSTRUCTION COMPANY TO OBTAIN ADDITIONAL PROPERTY IN THE IMMEDIATE AREA WITHIN
<br />400 FEET AS STIPULATED UNDER THE BUILDING ORDINANCES TO AFFORD ADDI TIONAL PARKING
<br />SPACES AND ELIMINATE THAT PART OF THE PARKING FACILITIES WHICH PROTRUDED OVER
<br />THE SEVEN FOOT ALLEY WAY, THEREBY LOSING NO PARKING FACILITIES AND STILL REMAINING
<br />ON THEIR OWN PROPERTY. THIS SUGGESTION WAS MADE WITH THE THOUGHT THAT POSSIBLY
<br />THE PROPERTY ACROSS 16TH AVENUE COULD BE PURCHASED AND UTILIZED FOR PARKING
<br />FACILITIES AND THAT BY ELIMINATING THE ONE-STORY GARAGE PARKING PROTRUDING ON THE
<br />SEVEN FOOT ALLEY WAY THAT POSSIBLY THERE WOULD BE NO GREAT DIFFERENCE IN COST."

<br />A LETTER FROM THE VETERANS MEMORIAL ASSOCIATION RELATIVE TO THE REQUEST THAT THEY DEED
<br />SEVEN FEET FROM THE WEST SIDE OF THEIR PROPERTY SO THAT A FOURTEEN FOOT ALLEY COULD BE
<br />MAINTAINED IF THE CITY DEEDED SEVEN FEET TO THE COATES CO~RUCTION COMPANY WAS READ AS
<br />FOLLOWS:

<br />"COMPLYING WITH YOUR REQUEST MADE TO MR. UREY, THE DIRECTORS AND OFFICERS OF THE
<br />VETERANS MEMORIAL ASSOCIATION MET LAST NIGHT TO CONSIDER THE PROPOSITION OF ACCEPTING
<br />A SEVEN FOOT STRIP OF GROUND ALONG THE WEST SIDE OF OUR PROPERTY, TOGETHER WITH SOME
<br />OTHER CONSIDERATION, AND THEN IN EXCHANGE THEREFORE GRANTING TO THE CITY AND TO THE
<br />PUBLIC A PERMANENT 14 FOOT EASEMENT THROUGH OUR PARKING LOT FOR ALLEY PURPOSES.
