"'--'.--'-.- <br /> <br />T <br />I, <br /> <br />-"--~ ._.,,~-_..~ .- <br /> <br />---.-- . <br />-... -",--. - - - _..~ ,--_.'- <br /> <br />Hf <br /> <br />I <br />I <br /> <br />COMMUNICATION FROM THE FIRE DEPARTMENT - RE: RECOMMENDATION OF ADOPTION OF NATIONAL <br />PROTECTION ASSOCIATION AND THE NATIONAL BOARD OF FIRE UNDERWRITERS' HOSPITAL FIRE SAFETY <br />STANDARDS FOR NEW AND EXISTING BUILDINGS HOUSING INVALIDS OR CONVALESCENTS, WAS SUBMITTED <br />READ AS FOLLOWS: <br /> <br />FIRE <br /> <br />AND <br /> <br />"A COMPLETE SURVEY OF THE REST HOMES, CONVALESCENT HOMES AND RETIREMENT HOMES OF <br />EUGENE WA~ MADE LAST MONTH. <br /> <br />THESE BUILDINGS ARE ALL OF FRAME CONSTRUCTION OF ONE TO THREE STORIES IN HEIGHT, <br />OCCUPIED BY AGED AND BEDFAST PATIENTS VARYING IN NUMBER FROM 3 TO 60 PATIENTS PER BUILDING. <br />THEY HAVE REASONABLY COMPLIED WITH EXISTING STATE AND CITY LAWS GOVERNING THIS TYPE OF <br />OCCUPANCY. <br /> <br />AFTER READING ABOUT THE HOQUIAM, WASHINGTON REST HOME DISASTER LAST JANUARY WITH THE <br />RESULTANT LOSS OF 21 LIVES OUT OF 30 AGED OCCUPANTS, WE BECAME DEEPLY CONCERNED DUE TO <br />OCCUPANCIES OF SIMILAR CONSTRUCTION IN EUGENE. <br /> <br />LATEST REPORTS DO NOT INDICATE ANY MAJOR INFRACTIONS OF EXISTING LAWS IN REGARD TO <br />THE HOQUIAM FIRE. THIS HOWEVER DID NOT PRECLUDE THE SHOCKING DISASTER THAT TOOK PLACE <br />THERE AND OUR RECENT SURVEY SHOWS A LIKE HOLOCAUST COULD HAPPEN HERE. <br /> <br />THEREFORE; WE URGENTLY RECOMMEND THAT THE CITY OF EUGENE ADOPT, IN FULL, THE <br />NATIONAL FIRE PROTECTION ASSOCIATION AND THE NATIONAL BOARD OF FIRE UNDERWRITERS' HOSPITAL <br />FIRE SAFETY STANDARDS FOR NEW AND EXISTING BUILDINGS HOUSING INVALIDS OR CONVALESCENTS." <br /> <br />IT WAS MOVED BY ALLEN, SECONDED BY BOOTH THAT THE COMMUNICATION BE REFERRED TO THE PUBLIC <br />SAFETY COMMITTEE. MOTION CARRIED. <br /> <br />COMMUNICATION ~ROM FINANCE OFFICER - RE: UNPAID ASSESSMENT LEVIED AGAINST THE UNITED <br />STATES GOVERNMENT (WILLAMETTE NATIONAL FOREST WAREHOUSE) FOR A PART OF THE COST OF A SEWER <br />ON WEST FIRST WAS SUBMITTED AND READ AS FOLLOWS: <br /> <br />"ON NOVEMBER 14, 1949 THE CITY LEVIED AN ASSESSMENT AGAINST THE UNITED STATES <br />GOVERNMENT FOR A PORTION OF THE COST OF THE SEWER ALONG WEST 1ST AVENUE WHERE CERTAIN <br />PROPERTY OF THE WILLAMETTE NATIONAL FOREST IS LOCATED. THE SITE IS OCCUPIED BY THE <br />WILLAMETTE FOREST WAREHOUSE. <br /> <br />ON THE OCCASION OF THE COUNCIL AT WHICH THE ASSESSMENT WAS MADE MR. CLYDE QUAM, <br />REPRESENTING THE WILLAMETTE NATIONAL FOREST, INFORMED THE COUNCIL THAT THE WILLAMETTE <br />NATIONAL FOREST WAS WITHOUT AUTHORITY TO PAY THE ASSESSMENT A~D THAT THERE EXISTED A <br />VERY SPECIFIC RULING CONTRARY TO PAYMENT OF SPECIAL ASSESSMENTS. <br /> <br />THE AMOUNT OF THE ASSESSMENT IS $1,271.25 AND TWO DISTRICT IMPROVEMENT WARRANTS <br />HELD BY THE CITIZENS NATIONAL BANK OF PORTLAND CANNOT BE CALLED UNTIL THE ASSESSMENT OF <br />$ I , 27 I . 25 I SPA I D. <br /> <br />IT WOULD BE MY RECOMMENDATION THAT THIS ASSESSMENT BE PAID BY THE CITY OUT OF THE <br />SPECIAL SEWER FUND AND THAT THE UNITED STATES GOVERNMENT BE INFORMED BY LETTER THAT THE <br />LIEN WILL ATTACH TO THIS PROPERTY IN THE EVENT OF A TRANSFER." <br /> <br />IT WAS MOVED BY ALLEN, SECONDED BY BOOTH THAT THIS ASSESSMENT BE PAID BY THE CITY OUT OF <br />THE SPECIAL SEWER FUND AND THAT AN EFFORT BE MADE TO COLLECT THE AMOUNT DUE BY BILLING AS A <br />CONNECTION CHARGE AND IN THE EVENT OF NON-PAYMENT, THE UNITED STATES GOVERNMENT BE INFORMED BY <br />LETTER THAT THE LIEN WILL ATTACH TO THIS PROPERTY IN THE EVENT OF A TRANSFER. BARKER FOR PURCHASE OF <br />FORECLOSED PROPERTY PURPORTEDLY OWNED BY THE STATE OF OREGON WAS SUBMITTED AND READ AS FOLLOWS: <br /> <br />"ON JANUARY 8,1950 WE LEVIED AN ASSESSMENT AGAINST LOT 10, BLOCK 17, CHAMBERS <br />ADDITION, AN UNIMPROVED PROPERTY, FOR THE PROPORTION AT PART OF THE COST OF LATERAL <br />SEWER. THE AMOUNT WAS $171.95. <br /> <br />THE RECORD OWNER, WHEN IT WAS ASSESSED, WAS H. L. ADAMS, % W. L. WOODS, GENERAL <br />DELIVERY, EUGENE, BUT ALL NOTICES SENT OUT BY US TO HIM WERE RETURNED TO US UNCLAIMED. <br /> <br />SUBSEQUENTLY, WE INCLUDED THIS PROPERTY IN A FORECLOSURE SALE (SALE OF AUGUST 7, 1950) <br />DOING ALL THINGS NECESSARY IN THE WAY OF SENDING NOTICES AND PUBLISHING ADVERTISEMENTS <br />PRIOR TO THE SALE. NOTICES WERE RETURNED UNCLAIMED. NOTICE OF THE SALE WAS PUBLISHED ',N <br />THE EUGENE REGISTER-GUARD FOR FOUR (4) CONSECUTIVE WEEKS AND THE LOT WAS POSTED WITH THE <br />NOTICE OF FORECLOSURE. <br /> <br />A CERTIFICATE ON THIS LOT WAS PURCHASED AT THE FORECLOSURE SALE ON AUGUST 7, 1950 <br />BY M. S. BARKER FOR $194.29 ON A BID OF NO PENALTY OR INTEREST ON THE REDEMPTION. <br /> <br />LATER IN AUGUST DURING AN EXAMINATION OF PROPERTY TRANSFER RECORDS FOR OTHER <br />PURPOSES, IT WAS NOTED THAT THIS PROPERTY WAS TRANSFERRED FROM A P.
