WOODRUFF STATED THAT IF THE COUNCIL WOULD GRANT A VARIANCE FOR THE USE OF THE PROPERTY <br />FOR A USED CAR LOT THAT IT WOULD NOT HAVE ANY ENTRANCES FROM FRANKOIN BOULEVARD, AS THE <br />ENTRANCE WOULD BE FROM ALDER STREET WHERE THERE IS AN EXISTING DRIVEWAY ALREADY IN. HE <br />STATED THAT THE AREA WOULD BE FILLED WITH CRUSHED ROCK AND TOPPED WITH CRUSHED GRAVEL AND <br />THAT A TRAILER HOUSE WOULD BE USED FOR AN OFFICE WITH PROPER SEWER CONNECTIONS. <br /> <br />THE COMMITTEE FELT THAT THE USE OF THIS PROPERTY IN THIS MANNER WOULD NOT BE A <br />DETRIMENT TO THE SURROUNDING PROPERTY, NOR WOULD IT IN ANY WAY CONFLICT WITH THE TRAFFIC <br />IN THIS AREA AND RECOMMENDED THAT MR. WOODRUFF BE GRANTED A VARIANCE FOR THIS PURPOSE. <br /> <br />I <br /> <br />4. IT WAS RECOMMENDED THAT THE CONTRACT BE AWARDED TO GLENWOOD SAND & GRAVEL COMPANY <br />UPON THE BASIS OF THEIR LOW BID OF $29,599.25 SUBMITTED UNDER DATE OF JUNE 26, 1950 FOR <br />THE PAVING OF 24TH AVENUE FROM WILLAMETTE TO HILYARD STREET. THIS BID TO BE AWARDED UPON <br />THE SAME UNIT PRICE BIDS AS OUTLINED IN THE ABOVE BID PRICE AND THE STREET TO BE A WIDTH <br />OF 36-FEET. THE CITY ATTORNEY HAS SUBMITTED A WRITTEN OPINION THAT THIS MEETS WITH THE <br />LEGAL REQUIREMENTS OF THE CHARTER OF THE CITY OF EUGENE AND OF THE STATE BANCROFTING LAWS." <br /> <br />IN THE MATTER OF SECURING THE PROPOSED SEWAGE DISPOSAL PLANT SITE, IT WAS MOVED BY CRUMBAKER <br />SECONDED BY ALLEN THAT THE RECOMMENDATION OF THE COMMITTEE BE ADOPTED AND THAT THE CITY MANAGER <br />BE INSTRUCTED TO COMPLETE THIS TRANSACTION ON THE SITE. MOTION CARRIED. <br /> <br />REPORTS OF BOARDS AND COMMISSIONS <br /> <br />7 <br /> <br />A REPORT OF THE BOARD OF ApPEALS - RE: VARIANCE TO ZONING ORDINANCE; USE OF CERTAIN TyPES <br />OF ROCK LATH AND STEEL STUD PARTITIONS AND SUSPENDED CEILINGS WAS SUBMITTED AND READ AS FOLLOWS: <br /> <br />"THE BOARD OF ApPEALS HELD A MEETING MARCH 8,1951 TO CONSIDER A REQUEST FOR WAIVER <br />OF THE ZONING ORDINANCE REQUIREMENTS RELATIVE TO THE R-2 DUPLEX ZONE. <br /> <br />MR. AND MRS. PAUL H. HAMILTON OWN THE PROPERTY AT 1241 W. 4TH AVENUE WITH A HOUSE <br />AND GARAGE IN THE REAR. THE LOT IS 55-2/3-FEET BY 160-FEET CONTAINING 8906 SQUARE FEET. <br />THE HOUSE IS 29-FEET BY 30-FEET IN DIMENSION AND CONTAINS 870 SQUARE FEET. <br /> <br />I <br /> <br />THE OWNERS HAVE REQUESTED PERMISSION TO CONSTRUCT A RESIDENCE ON THE FRONT OF THE <br />LOT WHICH IS CONTRARY TO THE DUPLEX REQUIREMENTS. <br /> <br />SINCE THIS IS A CHANGE OF LAND USE THE BOARD DOES NOT HAVE JURISDICTION TO GRANT <br />THE REQUEST AND RECOMMENDED THAT SAME BE REFERRED TO THE COMMON COUNCIL FOR DECISION IN THE <br />MATTER. THEY FURTH~R SUGGESTED THAT THE OWNER SECURE A LETTER FROM THE ADJOINING NEIGHBORS <br />AS EVIDENCE THAT THERE WAS NO OBJECTION BY THE ADJOINING PROPERTY OWNERS. <br /> <br />COMMUNICATION WAS RECEIVED FROM THE U. S. GYPSUM COMPANY REQUESTING THE APPROVAL FOR <br />USE IN THE CITY OF EUGENE OF CERTAIN TYPES OF ROCK LATH AND STEEL STUD PARTITIONS AND <br />SUSPENDED CEILINGS. IN ACCORDANCE WITH FIRE TESTS SUBMITTED THIS TYPE OF CONSTRUCTION <br />WOULD MEET OUR ONE-HOUR FIRE RESISTANT REQUIREMENT. <br /> <br />SINCE THE BOARD OF ApPEALS IS EMPOWERED TO ACT UPON THE ACCEPTANCE AND USE OF <br />MATERIALS NOT SPECIFIED IN THE BUILDING CODE THE AFOREMENTIONED REQUEST WAS PRESENTED TO <br />THE BOARD FOR THEIR ACTION. <br /> <br />THE BOARD RECOMMENDED THE USE OF THE MATERIALS AS SPECIFIED IN THE REQUEST AS BEING <br />ACCEPTABLE FOR ONE-HOUR FIRE RESISTANT CONSTRUCTION." <br /> <br />IT WAS MOVED BY SMITH, SECONDED BY GODLOVE THAT THE REQUEST OF MR.
