THE MEETING WAS CALLED TO ORDER BY HIS <br />HONOR, MAYOR V. E. JOHNSON. THE FOLLOWING COUNCILMEN WERE PRESENT: BOOTH, GODLOVE, <br />KOPPE, SIEGENTHALER AND WATSON. <br /> <br />THE CITY RECORDER INFORMED THE COMMON COUNCIL THAT HE HAD BEEN ADVISED BY MR. JOHN <br />SHULER, OF WINFREE, MCCULLOCH, SHULER AND SAYRE THAT HE WOULD BE UNABLE TO APPROVE THE <br />AWARD OF THE $133,557.28 IMPROVEMENT BONDS TO KALMAN & COMPANY FOR THE REASON THAT THE <br />KALMAN BID DID NOT CONSTITUTE ,A PAR BID. <br /> <br />THE CITY RECORDER THEN EXPLAINED THAT THE COUNCIL COULD ACT ON ONE OF TWO ALTERNATIVES. <br />ONE WAS TO AWARD THE BONDS TO THE NEXT BEST BIDDER OR TO REJECT ALL BIDS AND RE-ADVERTISE <br />FOR NEW BIDS. <br /> <br />IT WAS MOVED BY BOOTH, SECONDED BY GODLOVE THAT ALL BIDS BE REJECTED, THE GOOD FAITH <br />DEPOSITS RETURNED AND THAT A NEW ORDINANCE BE PASSED TO INITIATE THE PROCEEDINGS FOR NEW <br />BIDS ON THE ISSUE. MOTION CARRIED. <br /> <br />ORDINANCES <br /> <br />COUNCIL BILL No. I I 19 - RE: REPEALING ORDINANCE 9809 - ISSUANCE AND SALE OF <br />$133,557.28 IMPROVEMENT BONDS WAS SUBMITTED AND READ THE FIRST TIME IN FULL. <br /> <br />IT WAS MOVED BY BOOTH, SECONDED BY GODLOVE THAT <br />TITLE ONLY, WI TH UNANIMOUS CONSENT OF THE COUNCIL. <br />WAS READ THE SECOND TIME BY TITLE ONLY. <br /> <br />THE BILL BE READ THE SECOND TIME BY <br />MOTION CARRIED UNANIMOUSLY AND THE BILL <br /> <br />IT WAS MOVED BY BOOTH, SECONDED BY GODLOVE THAT THE RULES BE SUSPENDED AND THE BILL <br />BE READ THE THIRD TIME BY TITLE ONLY, WITH UNANIMOUS CONSENT OF THE COUNCIL. MOTION <br />CARRIED UNANIMOUSLY AND THE BILL WAS READ THE THIRD TIME BY TITLE ONLY. <br /> <br />IT WAS MOVED BY BOOTH, SECONDED BY GODLOVE THAT THE <br />GIVEN FINAL PASSAGE. ALL COUNCILMEN PRESENT VOTING AYE. <br />ABSENT. THE BILL WAS DECLARED PASSED AND NUMBERED 9857. <br /> <br />COUNCIL BILL BE APPROVED AND <br />CRUMBAKER, ALLEN AND ~MITH <br /> <br />COUNCIL BILL No. 1120 - RE: ISSUANCE AND SALE OF $133,557.28 IMPROVEMENT BONDS WAS <br />SUBMITTED AND READ THE FIRST TIME IN FULL. <br /> <br />IT WAS MOVED BY BOOTH, SECONDED BY GODLOVE THAT THE BILL BE READ THE SECOND TIME BY <br />TITLE ONLY, WITH UNANIMOUS CONSENT OF THE COUNCIL.
