NICHOLSON, MINISTER OF THE FI~ST CONGREGATIONAL CHURCH, <br />LOCATED AT THE SOUTHWEST CORNER OF 13TH AVENUE AND FERRY STREET, EUGtNE; ON BEHALF <br />OF THE MEMBERS, PRESENTED A REQUEST FOR WAIVER OF THE FIFTY FOOT SETBACK REQUIREMENT <br />FROM slbt LINE TO PE~MIT AN EXTENSION OF T8EIR SANCTUARY TO THE WEST. ALSO, THE REAR <br />'YARD SEtBACk OF THREE FEET ON THE ALLEY ALONG SOUTH, LINE OF THEIR PROPER1Y TO PERMIT <br />MOVING OF A RECRE~TIONAL BUILDING TO A DIFFERENT LOCATION'UPON THE REAR OF THE LOT. <br />FURtHER, REQUE~TING'WAIVER OF COVERAGE, WHICH WILL EXCEED THE 60 PER CENT PERMITTED <br />BY THE ORDINANCt~~ I <br /> <br />THIS-PROPERTY IS IN THE R-~ APARTMENT HOUSE ZONE AND BEING RESIDENTIAL REQUIRES <br />THE 50 fOOT SETBACK FROM INTERIOR PROPERTY LINES. CONSIDERABLE DISCUSSION ENSUED, <br />CgNCERNING'THE'NECE~SITY FOR EXPANSION OF THE CHURCH FACILITIES WITHIN THEIR LIMITED <br />-SPACE I~ND 'THE HAftbsH(P IMPOSED BY THE REQUI~ED FIFTt FOOT SETBACK, AND THE:PER CENT <br />OF COVERAGE ALLOWED. <br /> <br />THE PROPE~TY:OWNED BY THE CONGREGATIONAL CHURCH IS APPROXIMATELY 200' X 160' I,N <br />DIMENSION AND CONTAINS 32,000 SQUAftE FEET IN AREA. SIXTY PER CENT ALLOWABLE FOR <br />STRUCTURES WOULD PERMIT OF 19,200 SQUARE FEET OF BUILDINGS TO OCCUpy THIS PROPERTY. <br />THE EX I ST I NG BU I LD I NGS COVER A,N ,ES,T.I,MAT.ED 9,,000 SQUARE FEE T OF THE PROPERTY. <br /> <br />THE PROPOSED ADDITION FOR SANCTUARY:AND"EDUCATIONAL BUILDING WOULD EXCEED THE <br />60 PER CENT 'COVERAGE PERMITTED BUT NOT MORE THAN 70 PER CENT OR 22,400 SQUARE FEET <br />OF BUILDINGS. <br /> <br />~R. LUVAAS REQUESTED THAT THE REVEREND WESLEY G. NICHOLSON CONTACT ADJOINING <br />OWNERS AND SECURE FROM THEM 'STATEMENTS OF THEIR FEELINGS FOR OR AGAINST THE WAIVER. <br />'ALSO, THEISEC~ETA~Y WAS lNSTRUCTED TO WRITE THE PROPERTY OWNERS ADVISING THEM OF THE <br />INTENTION OF THE CHURCH AND INVITING THEIR PRESENCE AT A CALLED MEETING OF THE BOARD <br />Of ApPEALS. <br /> <br />THEREFORE, THE MATTER WAS TABLED UNTIL THE 'CHURCH SECURED SAID AGREEMENT FROM <br />THE ADJOINING PROPERTY OWNERS OR FAILING IN THIS EFFORT A PUBLIC HEARING BE HELD AT <br />A LATER DATE WITH THE ADJOINING PROPERTY OWNERS PRESENT. <br /> <br />THERE'~EING NO FURTHER BUSINESS, THE MEETING WAS ADJOURNED." <br /> <br />"THE BOARD OF,ApPEALS HELD A SPECIAL MEETING JANUARY 11,,1952 IN THE CITY HALL <br />TO FURTHER CONSIDER THE REQUEST OF THE FIRST CONGREGATIONAL CHURCH FOR WAIVERS OF <br />'- SETBACK AND LOT C-9VER~GE. PRESENT WERE MR. GILLILAN; MR. WILMSEN AND MI'!. VAALER. <br />MR. 'LUVAAS WAS ABSENT. <br /> <br />REPRESENTING THE PROPERTY OWNERS TO THE WEST OF AND ADJOINING THE CHURCH <br />PROPERTY, MRS. ANNA GASSMAN AND MR. L. GASSMAN. REPRESENTING THE CHURCH, REVEREND <br />WESLEY NICHOLSON AND MR. FRED EDMUNDS. <br /> <br />THE MATTER WAS PRESENTEp TO THE PROPERTY OWNERS AND A GENERAL DISCUSSION OF THE <br />PROBLEM'AND' ITS BENEFITS TO THE eHU"CH AND THE'POSSIBtE EFFECT THE STRUCTURE MIGHT <br />HAVE ON THE VALUE OF THE ADJOINING PROPERTY. MR. GASSMAN FELT TH~T THE:CHURCH <br />STRUCTURE BEING BUILT CLOSE TO HIS PROPERTY LINE MIGHT DEPRECIATE THE VALUE OF 'HIS <br />PROPE~TY. HE WAS ALSO CONCERNED ABOUT ELIMINATING THE NATU~AL LIGHT FOR HIS APART- <br />MENTS AND THE VIEW OF HIS TENANTS. THERE WOULD'BE APP~OXIMATELY 10 FEET BETWEEN THE <br />WEST END OF THE PROPOSED CHURCH STRUCTURE AND THE P~OPERTY OF MRS. GASSMAN. <br /> <br />THE ARCHITECT FO~ THE CHURCH IS PLANNING A MASONRY WALL FOR THIS END OF THE <br />BUILDING AND IT WOULD BE EITHER CONCRETE WITH BRICK VENEER OR A SOLID BRICK WALL. <br /> <br />AFTE~ FURTHER DISCUSSION OF THE PROBLEM, t~R. VAALER MOVED THAT THE REQUEST OF <br />THE CHURCH BE GRANTED TO'WAIVE TRE REQUIRED SETBACKS AND THE PER CENT OF COVERAGE. MR. <br />WILMSEN SECONDED THE MOTION. <br /> <br />MR. GILLILAN PUT THE QUESTION CONCERNING THE RIGHT Of THE PROPERTY OWNERS TO <br />APPEAL~ TO THE'COUNCIL'FOR RECONSIDERATION, ANDISECTION 22 OF THE ZONING ORDINANCE WAS <br />READ TO MR. GILLILAN WHICH SATISFIED THE QUESTION. VOTE WAS CALLED AND'ALL MEMBERS <br />PRESENT VOTED IN FAVOR OF GRANTING THE WAIVERS AS ~EQUESTED. THERE BEING NO FURTHER <br />BUSINES~, MtETING ADJOURNED." <br /> <br />IT WAS MOVED BY KOPPE, SECONDED BY GODLOVE THAT THE REPORT OF THE BOARD OF ApPEALS <br />BE REFERRED TO THE PUBLIC'WORKS COMMITTEE.
