ON JANUARY 12, 1954 AT <br />THE CITY HALL. THE MEETING WAS CALLED TO ORDER BY HIS HONOR, MAYOR V.E. JOHNSON WITH THE <br />FOLLOWING COUNCILMEN PRESENT: CRUMBAKER, GODLOVE, KOPPE, SIEGENTHALER, WATSON AND OWEN. <br />COUNCILMEN BOOTH AND CONE WERE AaSENT. THE CITY MANAGER; CITY ATTORNEY AND CITY RECORDER <br />WERE ALSO PRESENT. <br /> <br />c::r <br /> <br />e <br /> <br />THE MAYOR EXPLAINED THAT THE MEETING WAS CALLED TO CONSIDER THE SUBJECT OF RECENT <br />DEVELOPMENTS IN THE NEGOTIATIONS BETWEEN THE CI TY OF SPRINGFIELD AND THE CITY OF EUGENE <br />OVER AN EASEMENT THROUGH PROPERTY OWNED BY THE CITY OF EUGENE FOR INSTALLATION OF A SEWAGE <br />DISPOSAL OUTFALL LINE TO THE WILLAMETTE RIVER. THE MAYOR ASKED THE CITY ATTORNEY TO PRESENT <br />THE LATEST DEVELOPMENTS ON THE SUBJECT AND ADVISE THE COUNCIL AS TO WHAT ACTION MIGHT BE <br />TAKEN IN LIGHT OF THESE DEVELOPMENTS. <br /> <br />I <br /> <br />THE COUNCIL WAS BRI~FED BY THE CITY ATTORNEY ON THE CONTENT OF RECENT COMMUNICATIONS <br />fROM THE CITY Of SPRINGFIELD ON THE SUBJECT OF THE EASEMENT AND OF THE CURRENT STATUS OF <br />NEGOTIATIONS. HE STATED THAT IN VIEW OF THE FACT THAT THERE HAD BEEN A PUBLICLY EXPRESSED <br />-INTENTION OF THE CITY OF SPRINGFIELD TO FILE A CONDEMNATION SUIT AGAINST THE CITY OF EUGENE <br />IN THE EVENT SAID EASEMENT AS REQUESTED WAS NOT GRANTED BY THE CITY OF EUGENE, THAT IT WAS <br />POSSIBLE TO fiLE A DECLARATORY JUDGMENT SUIT WHICH WOULD DETERMINE THE LEGAL RIGHTS AND <br />OBLIGATIONS OF BOTH THE CITY OF SPRINGFIELD AND THE CITY OF EUGENE. HE INDICATED THAT IT <br />WOULD BE A FRIENDLY SUIT AND THAT THE CASE WOULD BE HEARD BY A JUDGE or THE CIRCUIT COURT <br />TO DETERMINE WHAT RIGHTS BOTH CITIES HAVE WITH RESPECT TO THE GRANTING OR SECURING OF AN <br />EASEMENT ACROSS PROPERTY OWNED BY THE CITY OF EUGENE. <br /> <br />IT WAS MOVED BY CRUMBAKER, SECONDED BY OWEN THAT THE CITY ATTORNEY BE AUTHORIZED TO <br />FILE A DECLARATORY JUD~~ENT SUIT TO DETERMINE THE RIGHTS OF BOTH THE CITY OF SPRINGfiELD <br />AND THE CITY OF EUGENE IN THE MATTER Of GRANTING OR SECURING OF AN EASEMENT ACROSS CITY <br />or EUGENE PROPERTY.
