THE MEETING WAS CALLED TO ORDER BY HIS HONOR, MAYOR V. E. JOHNSON WITH THE FOLLOWING <br />COUNCILMEN PRESENT: CRUMBAKER, BOOTH, GODLOVE, KOPPE, SIEGENTHALER, CONE AND OWEN. COUNCIL- <br />MAN WATSON WAS ABSENT. ~ <br /> <br />THE MEETING WAS CALLED FOR THE PURPOSE OF GIVING SPECIAL CONSIDERATION TO A REQUEST OF <br />THE SOUTHERN PACIFIC COMPANY POR AN ADDITIONAL TRACK ACROSS 5TH AVENUE AND HIGH STREET. <br /> <br />A REPORT OF THE PUBLIC WORKS COMMITIEE ON THE SUBJECT WAS SUBMITTED AND READ AS <br />FOLLOWS: <br /> <br />"PRESENT: MAYOR JOHNSON; COUNCILMEN CRUMBAKER, GODLOVE, KOPPE, SIEGENTHALER; <br />CITY MANAGER; CITY ATTORNEY; CITY ENGINEER AND CITY RECORDER. <br /> <br />THE PUBLIC WORKS COMMITTEE MET ON FRIDAY, MARCH 26TH. Two SUBJECTS WERE GIVEN <br />CONSIDERATION BY THE COMMITTEE. <br /> <br />I. REQUEST OF THE SOUTHERN PACIFIC COMPANY FOR A FRANCHISE FOR AN ADDITIONAL <br />TRACK CROSSING AT 5TH AVENUE AND HIGH STREET - THE COMMITTEE CONSIDERED THIS <br />REQUEST AT ITS MARCH 24TH MEETING, AND INSPECTED THE INTERSECTION AT 5TH AND <br />HIGH STREET. FURTHER CONSIDERATION WAS WITHHELD AT THAT TIME. <br /> <br />THE SUBJECT WAS AGAIN DISCUSSED AT THE MARCH 26TH MEETING AFTER ASSURANCE <br />HAD BEEN GIVEN BY THE SOUTHERN PACIFIC COMPANY THAT THE FORM OF FRANCHISE PRO- <br />POSED BY THE CITY WAS ACCEPTABLE. <br /> <br />IT IS WHEREFORE THE RECOMMENDATION OF THE COMMITTEE, SINCE IT IS AN URGENT <br />MATTER, THAT THE SOUTHERN PACIFIC COMPANY BE ISSUED A REVOCABLE PERMIT TO CON- <br />STRUCT THE TRACK ACROSS HIGH STREET PENDING THE APPROVAL AND PASSAGE OF THE <br />FRANCHISE ORDINANCE. <br /> <br />2. REQUEST OF MR. ANTON JENSEN FOR A VARIANCE FOR CONSTRUCTION AT 18TH AND <br />HIGH STREETS - THIS REQUEST WAS ALSO CONSIDERED AND IT IS THE RECOMMENDATION <br />OF THE COMMITTEE THAT THE VARIANCE BE GRANTED." <br /> <br />AFTER DISCUSSION, IT WAS MOVED BY CRUMBAKER, SECONDED BY BOOTH THAT ITEM I OF THE REPORT <br />WHICH PERTAINS TO THE SOUTHERN PACIFIC COMPANY REQUEST BE ADOPTED. MOTION C~RRIED. <br /> <br />IT WAS MOVED BY CRUMBAKER, ~ECONDED BY SIEGENTHALER THAT A REVOCABLE PERMIT BE GRANTED <br />TO THE SOUTHERN PACIFIC COMPANY, PERMITTING IT TO CONSTRUCT A NEW RAILROAD TRACK ACROSS <br />THE INTERSECTION OF HIGH AND FIFTH STREETS IN THE CITY OF EUGENE, OREGON. SAID REVOCABLE <br />PERMIT SHALL BE CONDITIONED UPON THE SOUTHERN PACIFIC COMPANY AT ALL TIMES COMPLYING WITH <br />ALL OF THE TERMS AND CONDITIONS SET FORTH IN THE PROPOSED FRANCHISE WHICH IS TO BE CON- <br />SIDERED BY THE COMMON COUNCIL OF THE CITY OF EUGENE ON APRIL 26, 1954. HOWEVER, SAID <br />PERMIT SHALL BE REVOCABLE AT ANY TIME AT THE WILL OF THE COUNCIL FOR ANY REASON WHATSOEVER <br />UNTIL A FRANCHISE SHALL BE GRANTED BY THE CITY AND ACCEPTED BY THE COMPANY. <br /> <br />DURING THE DISCUSSION WHICH FOLLOWED THE MOTION, THE COUNCIL HEARD MR. CHARLES SPARKS <br />OF THE EUGENE TRUCK & MACHINE COMPANY EXPLAIN HOW THE PROJECT MIGHT AFFECT THE GRADE OF 5TH <br />AVENUE EAST OF HIGH STREET. <br /> <br />AFTER FURTHER COUNCIL DISCUSSION, IT WAS MOV~D BY SIEGENTHALER, SECONDED BY CONE THAT <br />THE MOTION BE AMENDED TO INCLUDE THAT IT BE ALSO A CONDITION OF THE REVOCABLE PERMIT THAT <br />5TH AVENUE EAST OF HIGH STREET SHALL'BE BACKFILLED AND RECONSTRUCTED WITH ROCK IN SUCH A <br />MANNER AS TO LEAVE THE GRADE AND SURFACE IN THE SAMt CONDITION OF USABILITY AS IT WAS BE- <br />FORE CONSTRUCTION WAS STARTED WITHOUT CLOSING SAID 5TH AVENUE TO LESS THAN ONE-WAY TRAFFIC. <br />Mo TI 0 N CAR R lED. <br /> <br />A ROLLCALL VOTE WAS THEN TAKEN ON THE ORIGINAL MOTION AS AMENDED AND CARRIED UNANIMOUSLY.. <br /> <br />A SUGGESTED ORDINANCE REVISING THE PRESENT ORDINANCE ADOPTING THE OREGON STATUTES <br />PERTAINING TO.MOTOR VEHICULAR TRAFFIC WAS PRESENTED BY THE CITY ATTORNEY. IT WAS EXPLAINED <br />THAT THE ONLY CHANGE INVOLVED WAS THE REFERENCE TO THE SECTION OF THE NEW OREGON REVISED <br />STATUTES RATHER THAN THE FORMER OREGON COMPILED LAWS ANNOTATED. <br /> <br />IT WAS MOVED BY CRUMBAKER, SECONDED BY OWEN THAT THE DRAFT OF THE ORDINANCE BE REFERRED <br />TO THE PUBLIC SAFETY COMMITTEE FOR A REPORT AT THE APRIL 12TH MEETING.
