ADMINISTRATIVE ORDER NO. 58-17-19-F <br />of the <br />City Manager of the City of Eugene <br />INFLATIONARY ADJUSTMENT OF SYSTEMS DEVELOPMENT CHARGES <br />FOR TRANSPORTATION SYSTEM, LOCAL WASTEWATER SYSTEM, <br />STORMWATER SYSTEM, AND PARKS SYSTEM. <br />The City Manager of the City of Eugene finds as follows: <br />A. Section 2.020 of the Eugene Code, 1.971 (EQ, authorizes the City Manager of the <br />City of Eugene to determine and set fees and charges to be imposed by the City for services, goods, <br />use of municipal I property, and licenses and permits. EC 7.710(5) and Section 2.4 of the Systems <br />Development Charge (SDC) Methodologies authorize the City Manager to adopt by administrative <br />order pursuant to EC 2.020, a change yin the amount of a reimbursement fee or an improvement fee <br />if the change in amount is based on: (1) the periodic application of an adopted specific cost index <br />(inflationary adjustment); or (2) a modification to any of the factors related to rate that are <br />incorporated in the established methodologies. However, pursuant to Section 2.4 of the SDC <br />Methodologies, revisions of such fees in an amount greater than five percent within any 12 -month <br />period must be established by resolution of the City Council. <br />B. The SDC Methodologies were adopted by Resolution No. 4900 effective May 7, <br />2007, and have subsequently been amended by Resolution Nos. 4929, 4977, 4991 and 5100. <br />Inflationary adjustments to SDCs for the Regional Wastewater System, Parks System, Local <br />Wastewater System, Stormwater System, and Transportation System have been adopted, most <br />recently by Administrative Order No. 58-16-14-F, effective July 1, 2016. In addition, amendments <br />to the MWMC Capital Improvements List and MWMC SDC Fee Schedule for the Regional <br />Wastewater System were adopted by Administrative Order No. 58-17-02-F, effective March 10, <br />2017. <br />C. In accordance with the procedures set forth in Sections 2.020 and 7.710(5) of the <br />Eugene Code, 1971, after considering the applicable policies, enactments and directives of the City <br />Council, the amount charged for these services by the City in the past, the full costs of providing <br />these services supported by the fees, the amounts charged by other comparable providers, and the <br />revenue needs of the City as determined by the adopted City budget, on August 4, 2017, 1 issued <br />Administrative Order No. 58-17-19, proposing to implement inflationary adjustments to SDCs for <br />the Transportation System, Local Wastewater System, Stormwater System, and Parks System rates <br />as shown on Exhibit A attached to that Order. General descriptions of the adjustments are <br />described in Findings D and E below. <br />D. Based on the Engineering News -Record 20 -City national average Construction <br />Cost Index of 3.7% (May 2016 through May 2017), it is necessary to amend the Transportation <br />System, Local Wastewater System, and Stormwater System SDCs by implementing a 3.661/o <br />increase for those SDCs. As such, these increases will not result in a 5% or greater fee revision <br />within a 12 -month period. <br />Administrative Order -Page 1 of'2 <br />
