IN THE ABSENCE OF HIS HONOR, MAYOR J; J. <br />MCGINTY, THE MEETING WAS CALLED TO ORDER BY COUNCIL PRESIDENT C. F. SHEARER WITH THE FOLLOWING COUNCIL- <br />MEN PRESENT: MR. HARTMAN, MR. EDMUNDS, MRS. LAURIS, MR. LINDEEN AND MR. MCGAFFEY. MESSRS. SHISLER AND <br />MOLHOLM WERE ABSENT. <br /> <br />THE MINUTES Of THE REGULAR MEETING or MAY 12, 1958, AS MAILED TO MEMBERS OF THE COUNCIL, WERE <br />APPROVED. <br /> <br />INTRODUCTION OF NEW BUSINESS <br /> <br />IT WAS MOVED BY MR. MCGAFFEY SECONDED BY MRS. LAURIS THAT THE QUESTION or USING SPENCER BUTTE rOR <br />A TV TRANSMITTER BE RErERRED TO THE PEOPLE rOR A VOTE IN THE NOVEMBER GENERAL ELECTION. <br /> <br />e <br /> <br />A COMMUNICATION DATED MAY 23, 1958 FROM KEITH D. SKELTON, ATTORNEY FOR KEED, INC., WAS PRESENTED <br />AND READ AS FOLLOWS: <br /> <br />"THIS LETTER WILL ADVISE YOU or THE ACCEPTANCE BY KEED, INCORPORATED or THE <br />orrER OF THE CITY OF EUGENE TO LEASE A PORTION OF SPENCER'S BUTTE FOR 'TELEVISION <br />PURPOSES, SUBJECT TO THE DETAILS or THE PROPOSED LEASE SET fORTH IN YOUR orFER <br />or MAY 13TH, 1958. <br /> <br />1 <br /> <br />IN RELIANCE ON THIS OFrER KEED, INCORPORATED HAS fiLED AN APPLICATION FOR <br />CHANNEL 9 WITH THE FEDERAL COMMUNICATIONS COMMISSION, DESIGNATING SPENCER'S <br />BUTTE AS THE LOCATION OF THE TRANSMITTER TOWER. <br /> <br />As YOU KNOW, KEED, INCORPORATED IS IN COMPETITION WITH OTHER APPLICANTS FOR <br />THE SAME CHANNEL AND THE FAILURE OR SUCCESS or KEED's APPLICATION MAY VERY WELL <br />DEPEND UPON THE LOCATION or THE TRANSMITTER TOWER. IN BEHALF OF KEED, INCORPORATED, <br />THERErORE, I AM AUTHORIZED TO INFORM YOU THAT WE VERY MUCH APPRECIATE THE OPPOR- <br />TUNITY EXTENDED TO THE CORPORATION rOR THE USE or THIS AREA AS A SITE rOR A TRANS- <br />MITTER TOWER." <br /> <br />ALSO, A COMMUNICATION DATED MAY 23, 1958 FROM EUGENE RECREATION COMMISSION WAS PRESENTED AND READ <br />AS rOLLOWS: <br /> <br />"AT A RECENT MEETING OF THE EUGENE RECREATION COMMISSION, CONSIDERABLE DIS- <br />CUSSION WAS DEVOTED TO THE COUNCIL ACTION CONCERNING THE USE OF SPENCER BUTTE <br />rOR TELEVISION PURPOSES. As YOU MUST REALIZE, MANY or THE OPINIONS WERE NOT IN <br />ACCORD WITH THE COUNCIL THINKING AND THE UNDERSIGNED orrlCERS HAVE BEEN RE- <br />QUESTED TO CONVEY THE COMMISSION ATTITUDE. <br /> <br />IT IS FELT BY THE EUGENE RECREATION COMMISSION'THAT THE CITY COUNCIL ACTED <br />SOMEWHAT HASTILY IN THE ABOVE MENTIONED MATTER. IT IS FURTHER REALIZED THAT THE <br />COUNCIL'S ACTION WAS WITHIN AUTHORITY AS GRANTED BY A VOTE OF THE GENERAL <br />ELECTORATE A FEW YEARS BACK AND THAT THE TERMS OF THE TEMPORARY LEASE AGREEMENT <br />WERE IN ACCORD WITH THE SUGGESTED PROCEDURE AS RECOMMENDED BY THIS COMMISSION <br />rOLLOWING THAT EXPRESSION BY THE CITIZENS OF EUGENE. <br /> <br />I <br /> <br />SINCE THIS ISSUE HAS CAUSED A CONSIDERABLE AMOUNT or COMMENT WITHIN THE <br />COMMUNITY, THIS COMMISSION WOULD LIKE TO EXTEND ITS SERVICES TO THE EUGENE CITY <br />COUNCIL IN ANY CAPACITY THE COUNCIL MAY DESIRE. PERHAPS ~URTHER STUDY WOULD <br />HELP TO RESOLVE THIS MATTER SO THAT THE MAJORITY or THE PEOPLE WOULD ACCEPT <br />WHATEVER DECISION IS MOST ADVANTAGEOUS fOR THE GROWTH OF THIS COMMUNITY AND <br />STILL PRESERVE THE NATURAL BEAUTY WITH WHICH WE HAVE BEEN SO GRACIOUSLY ENDOWED." <br /> <br />- <br /> <br />AFTER CONSIDERABLE DISCUSSION DURING WHICH THE CITY ATTORNEY POINTED OUT THAT AT THE LAST COUNCIL <br />MEET I NG THE COUNC I L AGREED TO ENTER I NTO A CONTRACT WI TH KEED, I NC. FOR THE I NSTALLAT I ON OF:,A, TV <br />TRANSMITTER ON SPENCER BUTTE AND THAT IT WOULD NOT BE CONSISTENT rOR THE COUNCIL NOW TO REFER THE <br />MATTER TO THE PEOPLE rOR A VOTE, MR. MCGAFFEY WITHDREW HIS MOTION AND MRS.
