<br />"WHEREAS, THE STATE OF OREGON, BY AND THROUGH ITS STATE HIGHWAY COMMISSION, HAS
<br />APPLIED TO THE CITY OF EUGENE FOR RIGHT-OF-WAY FOR USE UPON THE McKENZIE
<br />RIVER-JUDKINS POINT SECTION OF THE PACIFIC HIGHWAY, OVER AND ACROSS
<br />CERTAIN LAND~ BELONGING TO THE CITY OF EUGENE, HEREtNAFTER MORE PAR-
<br />T1CULARLYDESCRIBED; AND

<br />WHEREAS, THE COMMON COUNCIL OF THE CITY OF EUGENE BE'ING OF THE OPINION THAT IT WILL
