<br />OPINION ON THE LEGALITY OF .ASSESSING CERTAIN PROPERTY HOLDERS FOR THE IMPROVEMENT OR
<br />WIDENING OF A STREET UP TO 44 FEET, THE QUESTION BEING WHETHER THE RECEN[LY ADOPTED
<br />POLICY THAT DIFFERENT USES OF PROPERTY BE ASSESSED FOR DIFFERENT WIDTHS OF STREET
<br />WIDENING PROJECTS IS LEGAL.

<br />THE PLANNING COMMISSION, AT THE REQUEST OF THE COUNCIL, RECOMMENDED AT THEIR
<br />APRIL 2, 1963 MEETING THAT A VARIANCE BE GRANTED TO JACK WILKINSON ON PROPERTY AT
<br />1943 AGATE AND SOUTH 50'X53.3' OF 1646 EAST 19TH TO ALLOW DEVELOPMENT TO A DENISTY
<br />NOT GREATER THAN THAT ALLOWED IN AN R-2 ZONE, PROVIDING THE OLD STRUCTURE ARE RE-
<br />MOVED FROM THE PREMISES.
