Rezone to C-2 area at northwest corner of West Amazon Drive and Larch Street, Maxwell - <br />The Planning Commission recommended rezoning this property from RA Outer Residential <br />subject to contractual agreement with the petitioner covering lighting plans, ex- <br />terior signs,' architectural plans for development, and delay of construction of serv- <br />ice station on the site until permits are issued for at least 50% of the remaining <br />structures of which at least 25% are complete. Mr. McNutt moved seconded by Mrs.LaurE <br />to concur in the Planning Commission recommendation. Motion carried. <br /> <br />. <br /> <br />Mr. Lassen moved seconded by Mrs. Hayward to approve Item 3a of the Committee report. <br /> <br />A petition signed by 26 home owners in the area and objecting to the rezoning and proposed shopping <br />center was presented and read. Wayne Carter, 4585 East Amazon Drive, opposed the rezoning on the <br />basis that it will create too much traffic, there are already other shopping centers and markets in <br />the area, and the development generally would be a nuisance to the residential area. T~e Planning <br />Director said restrictions would be written into an agreement covering the rezoning, requiring proper <br />landscaping and prohibiting high intensity lighting. <br /> <br />I <br /> <br />Mr. Slaughter, owner of the Jiffy Market at 3443 Hilyard, remarked that there is not enough business in <br />the area to warrant another shopping center. The City Manager said the Planning Commission can con- <br />sider only land use when deciding on zone change requests. <br /> <br />A vote was taken on the motion to approve, and motion carried unanimously. <br /> <br />2 <br /> <br />4. Planning Commission Report - December 5, 1967 <br />a. Amending Zoning Ordinance, Veterans Group Care Homes - The Planning Commission recom- <br />mended amendment of the zoning ordinance to define U. S. Veterans Administration <br />Group Care Homes and allow them in R-4 through commercial zones, and as a condi- <br />tional use in R-l, R-2, R-3, andR-3G zones. Mr. Anderson moved seconded by'Mrs. <br />Lauris to approve. Motion carried. <br /> <br />. <br /> <br />3 <br /> <br />b. Vacation Easement Firland Heights, Western Engineers - The Planning Commission recom- <br />mended vacation of a l4-foot utility easement between Lots 3 and 4, Block 2, and be- <br />tween Lots 3 and 4, Block 3, Firland Heights (off 30th Avenue). Substitute easements <br />have been dedicated, and the Public Works Department has no objection. Mrs.Lauris <br />moved seconded by Mr. McNutt to approve. Variance to allow garden center at Willamette and Donald, Hirons - The Planning Com- <br />mission recommended granting a variance which would allow a garden center in R-l and <br />R-3G zones at Willamette and Donald. Henry Camarot, attorney representing John <br />Hirons, asked that sale of gift accessories be allowed. James Pearson, Planning <br />Commission member, said the Planning Commission thoroughly discussed the l~ of <br />items to be allowed for sale, and if the scope is enlarged the matter should be re- <br />ferred back to the Commission. Mr. Camarot suggested limiting the gift accessories <br />to small garden-type items. Mr. Wingard moved se~onded by Mrs. Lauris to grant the <br />variance and to include small garden and flower oriented gift accessories in the <br />merchandise allowed. Motion carried. <br /> <br />I <br /> <br />- <br /> <br />5 <br /> <br />5. Planning Commission Report - December 11, 1967 <br />a. Vacation and Dedication, Maxwell Road at Highway 99N - The Public Works Department <br />recommended vacation of a portion of Prairie Road between Maxwell Road and the <br />Oregon Electric right-of-way and of an unnamed street between Highway 99N and Bethel <br />Drive between the Rickhoff and Beckley Estate properties. Also recommended was ex- <br />change of property with the Beckley Estate at Prairie Road railroad crossing to al- <br />low realignment and extension of Maxwell Road to Highway. 99N. The Prairie Road <br />vacation will be completed when a grade crossing north of the present crossing over <br />Oregon Electric tracks is granted by the Public Utilities Commissioner. Mrs.Lauris <br />moved seconded by Mr. McNutt to approve the vacation and exchange of properties. <br />Motion carried. <br /> <br />. <br /> <br />Councilman Lassen asked if there would be any change in alignment of Empire Park <br />Drive across Highway 99N from Prairie Road and was told none is anticipated at <br />this time. <br /> <br />I <br /> <br />6 <br /> <br />6.
