<br />Ii Councilman Purdy said he received a ruling from the City Attorney. that there is no conflict .of in-
<br />I; terest with regard' to his (Purdy's) voting on this item. Mr. Rubenstein raised the question, .
<br />, Dr. Purdy said, beca4se a renter in a building in which Dr. Purdy has a part interest might move to'
<br />the building proposed by Mr. Rubenstein. Dr. Purdy said h~ voted against granting the egress because
<br />it had been difficult to accomplish the Charter amendment permitting limited access road$, that
<br />limited access roads should be retained as such, and that he felt it was in the pest ineeFests of the
<br />City.

<br />A letter from the Eugene-Springfield Area'Transportation Study Advisory Committee was read urging re-
<br />tention of Amazon Parkway as a limited access street, and recommending denial of the off~~amp. Mrs.
<br />Robert Moulton member of the Committee, urged denial of the request and said the Committee felt the
<br />I' precedent set if this egress is granted would result in the Committee's having to fight the'same
<br />i! bstt1e again and again in the future.

<br />Councilman Anderson asked if it is feasible to plan the development. to provide for acce~s from the
<br />Parkway at some future time if it is found enough traffic is generated to warrant it. Mr. Poticha
<br />said he" believed it could be so constructed although difficult. He also said if the egress is not
<br />granted, he dpesn't believe his client should be requested to const~uct access from the Par~ay ,should .,~
<br />the traffic problems arise because of the development. ' ,

<br />Councilman Lassen asked if the motion included payment by the. developer of costs involved or any
<br />obligation on the part of the City to refund 'the difference in cost should the access be closed. He
<br />mentioned the difference in cost of right-1f-way from those properties where access was denied.

<br />Mr. Wingard moved seconde~ by Mr. Lassen to amend the motion to include that all costs involved in 411f~
<br />construction of the egress shall be paid by the property owner.as well as cost of land originally ,~
<br />taken for right-of-way; cost of improvement of the Parkway which would have been assessed had access ,-,--'
<br />not been denied, and any cost for removing the access should the permit be revoked. Motion carried.

<br />A rollcall vote was taken on the original motion as amended, and motion as amended carried - Messrs.
<br />McNutt and Lassen, Mrs. Hayward,and Messrs: McDonald and Wingard voting yes; Mr. Anderson, Mrs.Lauris,
<br />and Dr. Purdy voting no.

<br />signs which would be affected by the ordinance.

<br />Westward Ho, 3090 Harlow Road - A'mem? from the City ~ttorney informed the Cquncil 'that Westward Ho
<br />offered to settle -the right-of-way condemnation for ($2,705.00 if a barn ontheir property is' removed
<br />by the City and if they are allowed to continue use of:their office site another year under the ~
<br />variance which expires .this month. The staff had no objection. .v

<br />Arnold Webber, 3725 Harlow Road - The City Attorney recommended. accepting:Mr: WebberJs offer to. settle

<br />3 I Filing Deadline, November Election - The City Attorney announced the filing deadline for petitions
<br />for Mayor and Councilmen will be Friday, August 23, 1968, 5':00 p.m. - He said 25 signatures of qualified.
<br />electors are required - within the ward for councilmen, and at-1~rge for the mayor.

<br />4 Jury Trials for Indigent Persons - The City Attorney recommended that the Gity consider removing from
<br />1 the Charter the provision of trial by jury for municipal court offenses, and asking the Legislature to
<br />remove the same provision from State law. The Bureau of Governmental Research concurs. A letter from
<br />Councilwoman Lauris 'was presented suggesting the American Civil ,Libe.rties Union be given the' oppor,-'
<br />,tunity to express their views, and Dr. Purdy suggested inviting members of the Lane County Bar Associa-
<br />tion. It was understood the item would be scheduled for a committee meeting.
