" _, _ '_' ~" ,~""'_o"" _ .
Mr. Robert McCrea" qa ttorney, representipg~ Mrs'.~ ':O'utka'" outlined the' background of this assessment,
stating that the Building'c,arid"Finance Departm~n,~s,....should have placed a lien on the property at
the time a building permit was issued. ,This. lien, '21'1ould have remained on the p.ropeEty wben.the
_builder sold _ it. When Outka 's bO-ugh~ the' propertY andit.was financed, the builder would have
paid,the-li'en,bei-ng' reimbursed< by'th'e' fiii'aIlee' 'e:omp.'ail'y.' Mr. Outka died in 1967 without know-
ledge of an assessment, and when mortgage insurance paid the mortgage, the potential lien was
not paid, leaving Mrs. Outka facing a $l,OOO assessment. Mr. McCrea feels that the City, having
failed to levy this assessment at the time the building permit was issued, and allowing this to
continue for such a period of time, should not now levy this assessment.

The City Attorney stated he had not reviewed this matter and asked that it be held over to give
,him an opportunity for study._Dr. Purdy asked that this be discussed at a work session. .~;:

-. - -' :. ~:y~~- "~~.
-:Mrs-~-HaYW9r9 .IT1qyed sE[cA"ncled by.M;t:;~cDop.a1d, that
'yO,Urlceil bill mlmber 'only', 'wit;h','Jnanim(3~.s--co.nsent
-::;;

the Counc il b i.l~:-=:~e read ,~he' > ~~~conc!,jtime~b.y~ .
of the Counci'l::,:::-'~N.9' com~_ns:-~:-' . ~.
- ~-:;:~--~ --~~- -.~-~-:~-~-- '-- ...:..
...... .-"-~ ~

Dr.' Purdymovea,'1)econded by Mr. McDonald to table this item, and that it be discussed at a work
session.
