Sah1strom - Mr. Baitis has indicated that there has not been <br />sufficient time for persons interested in this matter to be aware of the discussion at this <br />meeting. The Manager said Mr. Sah1strom has apparently received an earnest money offer on <br />sale of this property to a group who wish to finish the house and sell it. Mr. Baitis <br />asked that the Council postpone this matber, until at least the next committee meeting. <br /> <br />After Council discussion, Mr. Mohr moved seconded by Mrs. Hayward, to postpone until y.v:-ed- <br />nesday, May 21, discussion of abatement of property at 955 East 43rd, and to request the <br />City Attorney to prepare an abstract of the case up to this point. Motion carried. <br /> <br />Mrs. Hayward moved seconded by Mr. McDonald to approve Item 9 of the Committee report. Motion carried. <br /> <br />10. Reports, Weddings in Hendricks Park, and City Purchase of Pioneer Memorial Cemetery - The <br />Director of Parks ,and Recreation has reported on these matters for the information of the <br />City Council. Mayor Anderson said these reports will be taken under advisement. Gas Franchise, Rate Reconsideration - A twenty year gas franchise signed July 13, 1959, is <br />subject to redetermination in July of this year. The contract provides for payment of 2% <br />of gross receipts in exchange for rights to use city street system. The staff recommends <br />notification be given to renegotiate the amount of the percentage. Up to 3% may be <br />charged wit~out being charged to the consumer's bill. <br /> <br />Mrs. Hayward moved seconded by Mr. Gribskov to instruct the City Manager to proceed with <br />negotiation with the Gas Company for a possible increase in the franchise rate. Motion <br />carried. <br /> <br />Mrs. Hayward moved seconded by Mr. McDonald that Item 11 of the Committee report be approved. Motion <br />carried. <br /> <br />Other Items: <br /> <br />Bid for Paving Paths, Skinner's Butte Park - The Manager read a recommendation from the Parks <br />Department for ~ard to Eugene Sand and Gravel Company <br /> <br />Mrs. Hayward moved seconded by Mr. McDonald to award <br />Butte Park to Eugene Sand and Gravel for $4,997.32. <br />voting aye, motion carried. <br /> <br />the contract for paving paths in Skinner's <br />Ro1~ca11 vote. All councilmen present <br /> <br />I <br /> <br />Planning Commission Report, May 16, 1969 <br />a. Gordon T. Olson, north of 18th Avenue on east side of Oak Patch Road, request for <br />zone change from RA to R-2 for construction of apartments. The Planning Commission has <br />recommended final approval of rezoning from RA to R-2, and officially heard this request <br />on March 4, 1969, recommending to the City Council that approval be given.,.subject to <br />compliance with Planned Unit Development regulations. Final reading of the Ordinance was <br />held until final R-2 PD approval was given. The Planning Commission, on May 6, 1969, <br />after review of detailed plans, recommended final approval of the R-2 PD, subject to an <br />agreement between the City and Mr. Olsen, to insure compliance with the plans and drawings <br />submitted upon final planned unit development approval. <br /> <br />Mrs. Hayward moved seconded by Mr. McDonald that the Council approve rezoning of the <br />property at 18th Avenue on the east side of Oak Patch Road from RA to R-2FD. Easement Vacation, Hugo Kriekis, vacate aportion of a 14' PUE in Lot 4, Monaco Park, located <br />east of Cherry and south of Harlow Road. The Planning Commission recommended vacation of <br />this property. Because of a surveying error, a house was located so that there was a 2~ <br />foot encroachment into the utility easement. Utility companies have been contacted and find <br />no interference with present or potential use. <br /> <br />Mrs. Hayward moved seconded by Mr. McDonald to approve the vacation of easement of a portion <br />of a 14' Public Utility Easement in Lot 4, Monaco Park, located east of Cherry and south <br />of Harlow Road.
