<br /> Regular m~eting of the Common Counci1'of the city of Eugene, Oregon was called to order by His Honor
<br /> Mayor Lester E. Anderson at 7:30 p.m. on August 11, 1969 in the Council Chamber with the following
<br /> councilmen present: Mrs. Hayward, Messrs. Purdy, McDonald, Wingard and Teague, Mrs. Beal, Messrs.
<br /> Gribskov and MOhr. .,
<br /> Minutes of Council meetings held July 14 and 17, 1969 as mailed to Council members were approved.
<br /> Appointments - Mayor Anderson announced appointment of the following to serve on a committee
<br /> to study possible new sources of local government revenues: Mr. Joe Richards; Mr. Ralph Cobb;
<br /> Mr. Herman Kehr1i; Councilmen Nancy Hayward and George Wingard; Mrs. Betty Niven; Mayor Anderson
<br /> and City Manager Hugh McKinley.
<br /> il Assistant Municipal Judge - Council President Hayward said the Council had met in executive e
<br /> session for the purpose of choosing an Assistant Municipal Judge. Pierre Van Rysse1berghe was
<br /> elected.
<br /> Mrs. Hayward'moved seconded by Mr. McDonald that the Council appoint Pierre Van Rysse1berghe as
<br /> Assistant Municipal Judge for the city of Eugene. Motion carried.'-
<br /> Resignation, Chief of Police - The City Manager said he had, this morning, received a letter of
<br /> resignation from Chief of Police Ellsworth.He~:read the memorandum, and commended Chief Ellsworth I
<br /> on the excellent job he had done, and for. his contribution toward developing an outstanding police'
<br /> department in the City.
<br /> Mrs. Hayward commented that, as President of the Council, she wished to echo Mr. McKinley's
<br /> stat'ements, and that the entire City appreciates Chief Ellsworth's contribution to the city.
<br /> Mayor Anderson said he was sure Mrs. Hayward spoke for himself and th~ entire Council.
<br /> Health Department, Milk Inspection - Mayor Anderson outlined discussion of this matter at previous
<br /> committee meetings, and explained that the City may not, under State law, ban the sale of raw milk
<br /> without maintaining an inspection s'ervice. A letter was received from Dr. Fox, President of Lane
<br /> County Medical Society urging 'the City Council to maintain milk inspection service in the City.
<br /> He felt the City should continue to protect its citizens from the hazards of unpasteurized milk.
<br /> I In answer to Councilwoman Hayward's question, Assistant City Attorney Combs said the State was I
<br /> I responsible for milk inspection, but'had left one exception. A city within boundaries of the I
<br /> I State which wishes to have an inspection prognm may do so. Without this inspection, there can I
<br /> I
<br /> ,
<br /> be no restriction on the sale of milk, grading, etc. This includes sale of raw milk. Eug~ne is.
<br /> currently the only city in the State operating a milk inspection program. I
<br /> In answer to Councilman McDonald's question concerning reduction in the budget, the City Manager
<br /> said approximately $22,000.00 would have to be made up in the budget. Mr. McDonald said he had
<br /> II received a letter from Dr. Emile Furrer advocating continuance of the ban on raw milk sales in
<br /> the city of Eugene. I
<br /> I Mrs. Hayward-moved seconded by Mr. McDonald that the Council authorize continuance of the milk
<br /> inspection program.

<br /> I Councilwoman Hayward said she could not vote to allow the city to go backward in such an important
<br /> I health manner. She hoped citizens anxious to continue the program would request the legislature
<br /> to establish. such a program over the entire state.

<br /> Councilman Teague reaffirmed his position in favor of continuance of the milk inspection pro~ram. -

<br /> Ii A vote was taken on the motim and motion carried.

<br /> II Dr. Purdy requested the City Manager to bring back a recommendation on another means to reduce the
<br /> II budget by $22,000.
<br /> !I Appeal from Amortization, Daniel Hotel Supply, 2470 Chambers -Since Mr. Daniel had incomplete

<br /> 11 Mr~ William J. Daniel explained that he felt th~ Planning Commission action was unjustified, and
<br /> ,I

<br /> If that he could not afford to remodel his building to comply with requirements for a 15 year amort-
<br /> !i ization period. He felt. that no .complaint.s had been received, and that he was compatible with.
<br /> II the neighborhood.

<br /> II Mr. Rhodaback of the Planning Department explained that the complaints mentioned in the Planning
<br /> I I
<br /> I Commission report had been received from the Building Department, and that these had been
<br /> I received over a period of several years. There are no written statements in the files.

<br /> Ij Mr. Daniel wanted it clarified that he had been in this location since 1949, and that the
<br /> Planning Commission minutes were in error in this regard.

<br /> Ii There was a discussion concerning methods of bring Mr. Daniel's property up to code, and whether
<br /> 'I
<br /> I it could not be depreciated within the 15 year period allowed by the Planning Commission.
