Public Works Director ,said hi's'officel hadsupplie'd Mrs. <br /> Blumenstein with most of the estimates and figures on this project. The 'low bidder claimed a mistake <br /> on his bid in interpreting the plans. The staff met with him and recognized pis error, and brought the <br /> matter back before the' Council, where the bid was rejected as a mistake. One quarte~ of the project <br /> ran into rock work, and the contractor had to be compensated for this. The project was ~.redesigned8 to <br /> avoid some of ,the rock. ' The City has no effective way to back out, of a project when it becomes a <br /> problem area. <br /> In answer to Dr. Purdy's question, Public Works Director said regardless of where rock appears on the <br /> project, the whole project is assessed for its entirety. The line serves all the property and each pays <br /> a proportionate share. There are methods of determining where the rock would, be, but the City's ' <br /> cost would be too high to be feasible. ...... <br /> Mrs. Blumenstein felt there, should ,be some limitation as to percentage over contract estimate. She was <br />I sure the City was protected, and felt the property owners should also pe protected. Publ~c Works <br /> Director said in past years the City triedl to put the burden on the contractor, but things have changed, <br /> and the legal staff has .ruled if.. contractor runs into difficult conditions', h~ must be. paid-.' <br /> , . <br /> Mrs. Hayward commented it seemed if the contractor had the burden of the difference, the bids would <br /> , all run higher. . Mr. Allen agreed. <br /> - . ~'. , , , , .'\ , <br /> Mr. Teague asked for a report. suggesting a method so that, people would know of possible excessive costs <br /> ahead of time.
