<br />5. To~cs Project, Highway 99 and Roosevelt Boulevard - Public Works Director explained the
<br />nec~~sity for extra depth paving of Roosevelt Boulevard, and that the City would assess
<br />property owners for the 20% city cost of project. This would amount to approximately
<br />$9.71 per front foot.

<br />Mr. McDonald moved seconded by Mr. Teague that the Council accept the recommendation of the Public
<br />Works Department to assess property owners for the 20% city cost of the project and call a public
<br />hearing at time of call for bids. Motion carried.

<br />6. Alley Paving Petitions
<br />a. Between Oak and High, 27th to 28th, 50% - Councilwoman Hayward suggested that a policy
<br />be established to require builders of apartments to pave alleys which provide access
<br />to their parking lots, at the time of development. Dr. Purdy requested a report
<br />from the City Attorney whether, in areas where alleys intersect zoning classifications,
<br />paving can be required as a condition of issuance of building permit. Mr. Williams
<br />asked the administrative assistant to arrange for a report.

<br />Mr. McDonald moved seconded by Mr. Teague to approve paging of alley, between Oak and High, 27th
<br />to 28th.
<br />
<br />Mr. Mohr asked the City Attorney whether or not the entire project could be assessed to the apartment
<br />house on the west side of the alley. Attorney replied that the city has paved alleys on the basis
<br />of an agreement with the apartment house owner that he will pay the cost. If the city is going to
<br />assess for benefit, it will have to asses~ equally on both sides, unless it can get owners on the
<br />other side to pick up the cost.

<br />Mr. Mohr moved seconded by Mrs. Beal to amend the motion to affect that benefit accrues 100% to
<br />petitioners.
<br />
<br />City Manager suggested it might be prudent to study the problem of precedent and legality of cases
<br />of this nature before-taking action. He suggested the matter be tabled until this is done.
<br />
<br />Mr. Williams said he supported the City Manager's statement, because of legal ramifica~ions, and
<br />felt the petitioner should have the opportunity to withdraw the petition.

<br />Dr. Purdy moved seconded by Mr. Gribskov to table this item. Motion carried.

<br />Bid Opening, Parks Department - Sidewalks, Laurel Hill Park - Mr. K. A. Wardell was low bidder
<br />with a bid of $1,959.50 for installation of drain tile and sidewalk construction at Laurel
<br />Hill Park.

<br />Mr. McDonald moved seconded by Mr. Teague to recommend award to 10w bidder, K. A. Wardell.
<br />Rollcall vote. All councilmen voting aye, the motion carried.
