<br /> :1 Council Bill No. 9278 - Levying assessments for storm sewer within Prescott's Estates Subdivision,
<br /> was submitted and read in full the first time on September 28, 1970, held over to this meeting to
<br /> allow proper notice of assessment'to be given owners of affected properties, and brought back for
<br /> consideration with one written protest on file.
<br /> Ii Frank Prescott, 1855 East 28th, said he was Mrs.
<br /> Mr. Isabel Prescott's son, and asked to explain her
<br /> protest. He said they had asked to have a drainage problem alleviated, but did not feel they should
<br /> e be charged for this assessment, and'that'the sewer installation would not directly benefit the pro-
<br /> perty.
<br /> The Director of Public Works said installation of the storm sewer was required with the platting of
<br /> , the subdivision. The Department had been unable to reach agreement with Mrs. Prescott until some
<br /> i: corrections were made, but the agreement'was now' signed. There may be some other work required in
<br /> :! the future, but this cannot be determined until there is use for storm sewers in the future.
<br /> I !: Councilwoman Hayward asked if Mrs. Prescott had' a written guarantee the City would assume responsi-
<br /> ,
<br /> :! bility for correction.

<br /> " The City Manager said this is general city policy on any storm sewer. If it is built by the City and
<br /> needs further attention, that is the responsibili ty.',-of the City. The City has to maintain the system.
