<br /> Regular meeting of the Common Council of the city of Eugene, Oregon was called to order by Vice
<br /> President Charles Teague in the absence of Mayor Anderson and President McDonald - at 7:30 p.m. on
<br /> November 16, 1970 in the Council Chamber, with the following Gouncilmen present: Messrs. Teague
<br /> and Purdy; Mrs. Hayward and Mrs. Beal; Messrs. Gribskov, Mohr and Williams. Mr. McDonald was absent.
<br /> I. Public Hearing, Wayne Johnson Request - The City Manager explained that Foremost Systems has
<br /> filed an appeal to Planning Commission'-denial of conditional use permit for fifty dwelling units
<br /> for FHA 236 low to moderate income housing on property located south of West 28th between Ingals
<br /> Way and Adams Street. He read a letter from Mr. Wayne L. Johnson appealing the decision, and
<br /> stating that the denial was improper and invalid and that the Commission did not wish to encour-
<br /> age provision of- an adequate supply of housing for low income families by cooperation of the city
<br /> with potential sponsors.
<br /> e Mr. Wayne Johnson, 932 West 7th Avenue, said he was appealing this decision because he felt the
<br /> ordinance in itself was ineffective and weak. He had asked for denial or acceptance of a
<br /> conditional use application for an unknown, non-profit sponsor, rather than postponement. He
<br /> explained that he could apply under Planned Unit Development, but that there were advantages to
<br /> requestigg approval under a conditional use permit.
<br /> I Mr. Robert Terrell, 2988 Ingalls Way, said he represented residents in the area, and that they
<br /> wished to reaffirm objections voiced at the Planning Commission hearing.
<br /> Mr. C. S. Gregor, 2990 Ingalls Way, agreed with Mr. Terrell and with the staff recommendation.
<br /> He felt the lot was too small for fifty units.
<br /> Mr. John Porter, Planning Directer said the staff notes covered the basic points of the Plan-
<br /> ning Commission denial. Since Mr. Johnson did not want a postponement, the Commission could not,
<br /> at that time, take any other action.
<br /> Mrs. Betty Niven, Planning Commission member, outlined the basic differences between planned
<br /> unit development and conditional use permits. She said the Commission could not approve this
<br /> request at the time because there were so many things unresolved.
<br /> Mr. Johnson explianed that the development, under PUD would be too expensive for low income
<br /> hous ing. Under conditional use, the requirements for landscaping, for instance, would not be so
<br /> stringent.
<br /> Mrs. Niven pointed out that this site would have to be developed under PUD because it is not
<br /> suitable for subdivision. She said the reason for the conditional use provision is to allow
<br /> variation in density.
<br /> Dr. Purdy moved seconded by Mrs. Hayward that the Council uphold the Planning Commission rec-
<br /> I commendation and deny a conditional use permit for construction of fifty dwelling units on
<br /> property located south of West 28th between Ingalls Way and Adams Street. Motion carried.
<br /> II. Public Hearings, advertised for this meeting.
<br /> A. Vacation of Beech Street from 13th Avenue 134' south - This vacation has been requested by
<br /> the University of Oregon. At the present time, no agreement has been reached regarding an
<br /> exchange of properties, and the property will be vacated at no cost to the University.

<br /> e. B. Vacation of Easement, Third Addition Foothnis West - It has been determined that this
<br /> particular easement is no longer required. A new easement will be dedicated in exchange.

<br /> C. Abatement, substandard building located at 1067 West 5th - The Council has received a report
<br /> regarding the hazardous condition of this building. A petition has Been received by residents
<br /> of the neighborhood objecting to the building and asking for its removal.
<br /> Mr. Richard Collins, 3110 RGyal, said 'he :was speaking ,for his father, Patrick Collins, who
<br /> was ill. He said his father, the owner of the p~operty, had ordered it boarded up, in
<br /> compliance with Building Department instructions, and planned to repair it within the
<br /> next month or two to bring it up to standard.
<br /> I The City Manager said it is not the purpose of the city to force removal of buildings if
<br /> they could be rehabilitated. If the building can be brought up to standard in six weeks,
<br /> the Council could proceed with the abatement resolution, but make it affective January 16,
<br /> 1971. If rehabilitation has not been achieved, the Council would not have to repeat the
<br /> hearing procedure.

<br /> D. Abatement, substandard bridge located over Amazon Creek south of 11th Avenue West and
<br /> e approx~mately at Quaker Street extended.
