<br />Mr. Ken Bylund, Lane County Labor Council, asked for clarification, and said he could see no reason for
<br />"
<br />the ordinance to be passed.
<br />
<br />The Assistant City Manager explained that there had been a problem concerning payment of wages. This
<br />ordinance would not set aside the state law, but would give the Council remedies in the e~~~t a
<br />contractor failed to perform his obligations.
<br />
<br />Mr. Bylund felt the Council was evading its responsibility. He voiced concern that the ordinance
<br />might create a hardship for workers. He felt there was a need for enforcement, rather than an
<br />additional law.

<br />The City Attorney said the City complies completely with the laws of the State regarding payment of
<br />minimum wages. He explained the basis for the ordinance and that the ordinance makes certain condi-
<br />tions specific, especially regarding violations regarding payment of wages and equal opportunity.
<br />
<br />Coqncilman Williams was concerned that the rights of individuals might be wornged, and felt that
<br />there were already adequate statutes. He felt that, not only the contractor would be put out of
<br />business, but the employe would also be put out of business.

<br />Councilman Mohr said the City was trying to accomplish something other than what he had suggested shou'ld
<br />be accomplished, and that another layer of penalty would be added to State law. He noted that this
<br />ordinance would not directly help the workman, as did the Human Rights Ordina~ce, by having the
<br />City Attorney prosecute the workman's case.
<br />
<br />Councilman Hershner was concerned that the penalty appeared to be mandatory. For the City to have an
<br />option to review, the ordinance would need amendment.
