Planning <br />I <br />iDirector answered that consultants were interviewed, one tentatively selected, and <br />ia contract was being reviewed by that consultant at this time. It is planned to <br />ihave a recommendation ready for Council action on January 28. <br /> <br />i <br />,It was understood that the consul tant would be contacted to determine whether a <br />,status report could be made as soon as possible .on the question of annexation of <br />: the entire Goodpasture Island area. <br />I <br /> <br />.In answer to Councilwoman Beal, Manager explained that annexation of the entire <br />:area was not pursued because it was felt unwise to prematurely proceed against the <br />:will of property owners in that area without having answers with regard to avail- <br />ability of sewer service. It is expected that sewer installation could not be started <br />ibefore 1977. He added that Mr. Moul ton was correct in saying that the DOerksen <br />,property could be served at this time by the system serving the K-Mart development. <br />';Public Works Director agreed that both properties under discussion could be served <br />'wi th existing temporary systems. However, he wanted it understood that if those <br />Iproperties were served in that manner, they would not be relieved of assessment <br />Ifor any future permanent system which might be made available. Facilities have <br />:been worked out with the developer of the DOerksen property from an engineering <br />:standpoint, he said, and they realize that there will be future assessments. <br /> <br />;Councilman Keller asked if there was any chance of a higher priority rating for <br />: the area' now that there was a Regional Sewer Commission. Manager answered that <br />,Eugene is about 85th in priority for Federal funds, and with funds that are now <br />available the City cannot expect anything before 1977. If other projects with <br />,higher priority do not develop during that time there is possibility of being funded <br />'sooner, but there is no basis for saying that will happen. <br /> <br />. <br /> <br />Councilman Wood wondered whether it would be advisable to communicate with the <br />Boundary Commission with regard to the DOerksen annexation petition prior to re- <br />sults of the study or the preliminary report. Manager answered that any action or <br />inaction on annexation petitions before the Council was always transmitted to the i <br />J <br />Boundary Commission, and there was always City representation at the Commission's ! <br />meetings. <br /> <br />Robert Moulton, attorney representing owners of the property across from K-Mart, stressed <br />the point that the annexation was in no way connected with land use. He said that even <br />though'present'Council policy was to ask the Planning Commission for recommendation on <br />annexations, there was no legal requirement for that action prior to transmittal to the <br />Boundary Commission. He hoped for a "no objection" report to the Boundary Commission so <br />that the Boundary Commission could take action. Developing the property under PUD re- <br />quirements, even without the moratorium in that area and allowing time for DEQ review, <br />would cause lengthy delay. Getting the annexation out of the way now would shorten the <br />time element. Developers would still have to come back to the Commission with regard to <br />land use, he said, but the City would not be committed to any rezoning by recommending <br />annexation. He pointed out that the property proposed for annexation could be served by <br />existing sewers. He added that it would seem the de- <br />velopers themselves would benefit by waiting. <br /> <br />In answer to Councilman Hershner, Manager said that the moratorium covered annexation as <br />well as land use or rezoning. <br /> <br />In answer to questions from Councilwoman Beal, Manager explained that if annexation was not <br />approved by the Boundary Commission prior to change of zone then the zone change applica- <br />tion would have to go to the County. City action on annexations were advisory, he said, <br />so zone change application would have to await official Boundary Commission action before <br />it could be taken to the City Planning Commission.
