North of Lewis and west of Adams - From RA to R-2 PO (Safley - M&M) <br /> Recommended by the Planning Commission on July 9, 1974. Copies of Planning Commission <br /> staff notes and minutes of that meeting were previously distributed to Council members. <br /> No ex parte contacts or conflicts of interest were declared by Council members. <br /> .. <br /> Jim Saul, planner, said that the area involved about nine acres and under the proposed <br /> zone maximum development would increase density to a medium_range. He described the <br /> existing uses of the property and said the Commission recommended that final reading <br /> of the ordinance effecting the rezoning, if approved, be withheld until final approval <br /> was given under planned unit development procedures. The Commission's main concerns <br /> to be reviewed upon presentation of preliminary plans for the property, he said, were <br /> the question of density and design as they related to the neighborhood and to the <br /> Willamette River, the south bank meandering from 150 to 300 feet from the property, line. <br /> Public hearing was opened. <br /> (0539) Gary Spivak, 1350 Bailey Avenue, said he was a member of the 'Whiteaker Community Council, <br /> e and that the neighborhood' was very much opposed to',the proposed zone change. He pre- <br /> sented a petition from residents of: the neighborhood ,opposing the change on the basis <br /> of adverse effect that development of the property to multiple-family housing would <br /> have upon the neighborhood and ,the riverfront. He felt the zoning: did not conform to <br /> the General Plan in that there was no consideration for environmental design in " <br /> preliminary planning, ,aistin~:tive. characteristics of the neighborhood would not be <br /> preserved, and public need for development of multiple-family housing in that area. <br /> was dubious. He said the development would be a major change for .the neighborhood <br /> and would take away completely an undeveloped section of t~e River. He felt there were <br /> a number of questions to be answered with regard to whether housi~g construction was <br /> keeping up with population growth and whether a development 'of this nature was right <br /> for the Whiteaker neighborhood when land inventories indicated adequate parcels available <br /> in more suitable locations. Mr. Spivak said the M&M proposal was not a medium density <br /> development and that it would have considerable impact on the River and on adjacent <br /> Sladden Park, already heavily used; that it would create a traffic problem because of <br /> limited access; and that conceivably it could lead to future rezoning of adjacentRA <br /> properties to multiple~family zoning. With,the Mayor's consent he called for a show <br /> of hands of those present from the Whiteaker neighborhood opposed to the proposed <br /> zoning - there were about 20 to 25. <br /> Mayor Anderson noted absence of the applicant, Mike Safley of M&M Oevelopment, , and <br /> .' the just received lengthy document setting .forth arguments. against the rezoning <br /> presented by Stephen J. Cross, 140 North Jackson Street. He,suggested holding the <br /> hearing over to give the applicant .a chance:to hear the argun;ents against the propos,al <br /> and to give Council members an opportunity to read the arguments presented, by Mr. ,Cross. <br /> (0670) Councilmen Murray.and McDonald thought the hearing should go forward since the applicant <br /> had been given notice ,the. Council had previously been given copies of the Planning <br /> Commission, record, and members of the Whiteaker, neighborhood present would be able <br /> to'give a verbal report covering material in Mr. Cross' submittal.
