It is important to note that authorized public displays <br />also generate a variety of noise complaints and impact the quality of life for many residents. <br />The City Council instituted a ban in Eugene on fireworks in July 2015 in response to drought -like <br />conditions for the Wildland Urban Interface (WUI) for properties south of 18th Avenue and east of <br />Agate Street. Over the past few years, increased fire patrols have been deployed to observe and <br />report illegal fireworks use and to provide public education. Designated locations create a problem <br />for the City or property owner due to the potential for property damage and injury when a high <br />number of participants using fireworks are in close proximity to one another. <br />Statutory Fines Currently in Place <br />The following shows ORS related to fireworks enforcement with maximum penalties: <br />• ORS 480.120 Unlawful Sale/Possession of Fireworks (Class B Misd) 6months jail, $2,500 <br />• ORS 164.315 Arson I/II (Class A/C Felony) 20 years prison, $375,000/ 5 years, $125,000 <br />• ORS 164.335 Reckless Burning (Class A Misdemeanor) 1 year jail, $6,250 <br />• ORS 164.365 Criminal Mischief 1 (Class C Felony) 5 years, $125,000 <br />• ORS 166.384 Manufacture of a Destructive Device (Class C Felony) 5 years, $125,000 <br />• ORS 166.382 Possession of a Destructive Device (Class C Felony) 5 years, $125,000 <br />Current enforcement and prevention activities include the Oregon State Fire Marshal's Office <br />working with the U.S. Postal Service and other private parcel carriers to identify, confiscate and take <br />enforcement actions on illegal shipments through the U.S. Mail. In addition, the Eugene Springfield <br />Fire Department responds locally to suspicious shipments identified by the U.S. Postal Service, as <br />well as other private parcel carriers and appropriate enforcement actions are taken against <br />violators prior to July 4. The Eugene Police Department conducts an amnesty turn in for all <br />fireworks. During the evening hours of July 3 and 4 each year, all fire suppression companies are <br />detailed to tour their respective areas, serving as a deterrent to inappropriate behaviors, along with <br />additional Eugene Police Patrol units and the Metro Explosive Disposal Unit. <br />COUNCIL OPTIONS <br />1. Direct the City Manager to schedule a public hearing on the draft ordinance. <br />2. Make changes to the draft ordinance and direct the City Manager to schedule a public hearing <br />on the revised draft ordinance. <br />3.
