ratifying the creation of the Metropolitan Wastewater Management Commission as an <br />Intergovernmental Entity. <br /> <br /> Section 3. Public Purposes of the Metropolitan Wastewater Management <br />Commission. The Metropolitan Wastewater Management Commission is created as an <br />Intergovernmental Entity for the public purposes of constructing, operating, maintaining and <br />financing regional sewerage facilities as provided in the Intergovernmental Agreement. <br /> <br /> Section 4. Powers~ Duties and Functions. The Metropolitan Wastewater Management <br />Commission, as an Intergovernmental Entity, shall have the powers, duties and functions <br />specified for it in the Intergovernmental Agreement, as that Intergovernmental Agreement may <br />be amended from time to time in accordance with its terms. <br /> <br /> Section 5. Approval~ Ratification and Filing. The City Council hereby approves and <br />ratifies the creation of the Metropolitan Wastewater Management Commission as an <br />Intergovernmental Entity and the terms of the Intergovernmental Agreement. The City Manager <br />is hereby authorized to execute the Intergovernmental Agreement on behalf of the City of <br />Eugene. A copy of this Ordinance and the corresponding ordinances enacted by the governing <br />bodies of the other two parties to the Intergovernmental Agreement, together with the statement <br />described in ORS 190.085(2), shall be filed with the Secretary of State as required by <br />ORS 190.085(2). <br /> <br /> Section 6. Effective Date. The Metropolitan Wastewater Management Commission <br />must be created as an Intergovernmental Entity before the Metropolitan Wastewater <br />Management Commission may borrow money to finance regional sewerage facilities. Because <br />delays in that borrowing may increase project costs and interest rates, this Ordinance shall <br />become effective immediately upon its passage by the City Council and approval by the Mayor, <br />retention by the Mayor for more than ten days, or readoption over a Mayoral veto by two-thirds <br />of all members of the City Council. <br /> <br />Passed by the City Council this Approved by the Mayor this <br /> <br />__day of ,2005 __day of .,2005 <br /> <br /> City Recorder Mayor <br /> <br />Ordinance - 2 <br /> <br /> <br />
