<br />ORDINANCE NO. 20415 <br /> <br />AN ORDINANCE AMENDING THE WILLAKENZIE AREA PLAN TEXT <br />IN THE WILLAMETTE GREENWAY SECTION; ADOPTING AN <br />EXCEPTION TO STATEWIDE PLANNING GOAL 15 WILLAMETTE <br />RIVER GREENWAY; AND ADOPTING A SEVERABILITY CLAUSE. <br /> <br />The City Council of the City of Eugene finds that: <br /> <br />A. On February 1, 2008 the Oregon Department of Transportation (ODOT) <br />submitted an application to the City of Eugene for a Metro Plan text amendment, an Exception to <br />Goal 15 Willamette River Greenway for the 1-5 Willamette Bridge Project. An application was <br />submitted at the same time for a text amendment to the Willakenzie Area Plan to allow for <br />placement of fill within 35 feet from the top of bank of the Willamette River. Pursuant to <br />provisions of the Eugene Code, 1971, the applications were processed concurrently. <br /> <br />B. A joint public hearing of the Planning Commissions of the City of Eugene, City <br />of Springfield and Lane County was held on April 29, 2008 and a joint public meeting of the <br />three Planning Commissions was held on June 3, 2008. Following the June 3, 2008 meeting the <br />Eugene Planning Commission recommended approval of the Willakenzie Area Plan amendment <br />and the taking of an exception to Statewide Planning Goal 15 Willamette River Greenway, to the <br />Eugene City Council. <br /> <br />C. The Eugene City Council conducted a joint public hearing on this amendment on <br />June 24, 2008 with the Springfield City Council and Lane County Board of Commissioners, and <br />is now ready to take action based upon the above recommendation and evidence and testimony <br />already in the record as well as the evidence and testimony presented at the joint elected officials <br />public hearing. <br /> <br />D. Substantial evidence exists within the record demonstrating that the proposal <br />meets the requirements of consistency with the approval criteria of EC 9.8424, and of applicable <br />state and local law as described in Exhibit A and Exhibit B, attached hereto and which are <br />adopted in support of this Ordinance. <br /> <br />NOW, THEREFORE, <br /> <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br /> <br />Section 1. Paragraph 1. of the Willamette Greenway section of the Neighborhood <br />Design Element of the Willakenzie Area Plan as currently set forth on page 155 of the Plan, is <br />hereby amended to read and provide as follows: <br /> <br />1. Provision that all new structures, expansion of existing structures, drives, parking areas, <br />or storage areas shall not be permitted within the first 35 feet back from the top of the <br /> <br />Ordinance - 1 <br />
